Terms of Service

I'm just setting up an online shop using Shopify and I've used their free online terms of service generator and there are a couple of bits on there that stand out as potential issues to me and I'm just wondering what everyone else thought of them...

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

This one stood out as a big issue to me. Is this even in line with consumer rights? Are stores not usually required to offer a refund if a customer is not happy with the item they have purchased (with a few exceptions) and is certainly required to correct any errors?

Hi,
I don't see this phrase being in contradiction with any refund policy you might have.
I don't comment on its legal attributes, but for me it's a way of stating the obvious ... can any store meet anyone's expectations? ... I doubt it. Well, if some product doesn't meet a customer expectations then he can return it.
Also, can any store owner warrant that he will fix "any error" perceived by a customer? ... "any" can mean a lot of things. This doesn't mean you will not do what you can to fix things.

It sounds complete garbage. You should get terms and conditions (not terms of service - you are not supplying a service) that meet your needs and are relevant to your type of business.

You could look at the terms of other shops.
And indeed look at the consumer law you will have to follow.

People may well ignore your terms that are not meeting legal requirements. Have lost count of the ebay sellers who run businesses who state no returns.

What of the expectations are set by the supplier's online description?

If I read that I am buying a book about marketing strategies I expect to get a book about marketing strategies. If I get a book about Noddy in Toyland my expectations have not been met.
