Stripe chargeback...

Hello again,

A business I purchased something from a few months ago is being investigated, it was sold to me illegally and they also charged me VAT without being VAT registered. This company informed me their Stripe account is closed since the purchase, likely their balance would be too low if Stripe agree this company who I made a purchase from are fraudulent... this company also denies any wrongdoing although I have a stack of evidence they don't know about.

Would Stripe still give me my money back if this company has no funds in their Stripe account or nor enough in any held funds?

Would Stripe have to refund me but have to take another course of action to recover the amount from the seller?

If anyone has any experience or knowledge of this that would be great.

Yes, do a chargeback.

It then becomes an issue between Stripe and the company.

My bank said as it was outside the 120 day window since the purchase they won't be able to do anything, went to TSB who I discovered is the bank this Ltd company use to receive money into their former director's personal bank account after I posed as a new customer etc...

TSB confirmed it is a personal account and not with the Ltd company payee name etc.

I told them everything, they advised me to contact my bank again to contact them to inform them who to speak to as is my bank contact TSB with the details, TSB can look into this for 12 months from the data of purchase. They will look for any Stripe deposits for the amount I paid minus about 3%, the day of purchase or a few days after, and contact Stripe to see if that deposit, or part of it leads back to my purchase.

It's complicated, and the seller is outright refusing to cooperate or confess to any wrongdoing despite my mountain of evidence.

They are now claiming to be victim or harassment and that I am intending to cause distress... because I got their account blocked and have been deceived, misled and charged VAT, and provided with a digital product I cannot use for compliance reasons and because it doesn't belong to the seller, who has no rights or permissions to resell or distribute - which I have in writing from the original owner.

It's madness really, but I have reported them to HMRC, ICO, my bank, their bank...

But if this company's Stripe account was closed, Stripe can't use any funds of theirs, so it would come out of Stripe's own funds who then have to collect it from the company's bank account if there are funds in it or chase TSB for it, or try to recover it through the courts or what?

I'm confident I'll get my money back somehow, but it is very stressful when realising you have become victim of a scam and have to spend all this time getting evidence and trying to prove something.
