I have tonight found out that a colleague was convicted of sexual assault, incite for penetration of a minor and inciting child pornographic images (cat B and C)
He received a suspended sentence due to his own health issues
This is 4-5 years later. I don’t know if he informed our employer, I don’t know if he received his conviction before or during his employ with the company. I work in construction so there are no children involved in the role but I, and most of my colleagues, have young children of the age he assaulted. Whilst we may not have a right to know, do our employers and do I have a right to refuse to work with him?
 
Your employers had the right to ask questions prior to employment, and get honest answers, subject to the Rehabilitation of Offenders Act. You do not have the right to refuse to work with him.

Everything depends on the circumstances and a suspended sentence suggests that the circumstances were mitigating.

What vetting processes does your business have in place when recruiting?
Do they ask if they have a criminal record?
Does the role include visiting client properties where children may be present? If so, then it’s an absolute no no that they should be going.

No self respecting employer would employ a paedophile and no decent company should expect any of their employees to work with one.

If one slipped through the ropes, sack them immediately, whatever the consequences.
