Working with companies in the US

Hi all,

I've just registered as I need help and wondered if anyone can help shed some light on my situation. I'm a director of a uk ltd company and work with a US client that pays us in GBP.

An old business partner set things up and I don't believe she did it correctly - she has recently informed me that she had a reminder to complete form 1065 within the next 2 days, which implies i need to declare all of the companies income to the IRS!

After some quizzing, it seems she registered us with the IRS and said that she thinks she filled in a W-8BEN-E form over the phone with them, but wasn't sure.

It is my understanding that we should never have been registered with the IRS and should have filled in the W-8BEN-E form and sent this directly to the people we are supplying a service to. Therefore no need to declare anything to the IRS etc.

Is this the case and, if so, is there any way of getting "un-registered" with the IRS?

I'm finding conflicting reports so thanks in advance for any help
