Of course they get a chance to purchase a licence.

That is our point, surely it's better to contact the infringer and play nice with a call or email explaining the situation rather than immediately send out a penalty notice?

This is the tack we take when we are approached by rights holders who are pursuing supposed "damages" from alleged infringer's. We also encourage copyright holders to ensure any claim is realistic and reflects the works true market value.

We will not act in cases where the supposed debt or unpaid invoice is based on some seemingly random damages amount. Truth be told we have seen some truly staggering "claims" over the years all of which, to our knowledge, remained unpaid.

I think you will find that Fotolia is significantly cheaper than Bigstockphoto for similar images and they have more of them. ;)

25 credits on Bigstockphoto = £39.00
25 credits on Fotolia = £25.00

Thanks... it's definitely a site worth considering BUT... I just did a one-minute search for a penguin shot that appears to be the same size and apparent quality as the one I identified in my previous post. I quickly found one 849x566 pixels http://en.fotolia.com/id/39898156

Fotolia charge 44 credits for this image. Bigshotphoto charged ONE :) (to me, the photos look equivalent)

Each "credit" on Fotolia might be thirty-odd percent cheaper, but if I need 44 of them to buy just one photo... ???

I know this is a simplification - I also quickly saw that some penguin shots were 3 credits on Fotolia (still a lot more expensive)... or even one credit if you want a really small photo.

I guess the conclusion we should definitely search a few sites, and with care, you can certainly pick up real value. I'll add Fotolia to those that I search.
