Got a £200 debt owing for months, from a particularly dodgy national used car franchise (rhymes with 'Pricks' -but then i should watch my p's and q's. )
If I institute proceedings, but they pay before the court date what happens? I have it in writing by the manager that they will pay - 6 weeks ago, also numerous ananswered emails which hardly helps their case. I've even threatened court action.
Can I claim for loss of working capital as well as the interest? they had four months to settle up. now I'll take them for other expenses which i had originally waived, another £300 plus court fees.
Is a hand delivered summons ok? they are slippery and will deny receiving it, could a copy be sent recorded delivery as well?
Would enforcement of a CCJ be a problem with such a company? thanks
