Rolling 12 month contracts and cancellation

    Hi Guys

    I have a service that I pay monthly for.

    I'm just about to cancel it and have been told that the cancellation date is the 30th April 2020

    1. If I pay for a service monthly is it classed as a monthly service and can therefore be terminated with a months notice.

    2. If it is a 12 month service with auto renewal. Am I correct in saying that the company has to notify me of the renewal date and time limits for cancellation before the renewal date?

    The company is based in the EU. not the UK.

    What does it say on the terms and conditions that you signed? I suspect that the service provider may well tell you that they notified you of the renewal date and time limits etc because they are on the contract you signed.

    What was the service? Can you argue that you were buying as a consumer and not as a business.

    Yes, but I'm sure that the provider has to notify you x days before the renewal each year.

    This contract has been running for about 6 years so it's not new. Surely they should notify me 28 or 30 days before the renewal.

    Yes - if that is in the contract.
    Otherwise its down to you to make note of the dates.

    As said, it depends what the T&Cs say.

    Some are quite wicked, eg if you don't give notice exactly on the second Wednesday after the third full moon you are locked in for another 5 years. Photocopiers and fire extinguishers often come into that category.

    Not for business-to-business. Strictly contract terms.

    I recently cancelled our contract with a service provider 6 months before the end of contract - based on their notification stipulation. In response to the "Oh dear, sir, I'm sorry, is there a problem with the service?" I just said I wanted to renew on my terms not theirs.
