recording of a telephone conversation by recruitment agent

Hi

Quite a few minutes into a telephone call I had reason to suspect and furthermore asked a recruitment agent if he was recording the call. Although denied, I had sensed previously he records all of his calls for reasons I wont go into. While denying he recorded it (and I think it fair to assume I mean with an electronic device or phone app), he stated he was not but his PA was listening to it and making notes. I have no evidence of that or to the contrary. According to Oftel it seems there could be legitimacy behind his reason for making the recording - e.g. to do with compliance.

In her first letter, his solicitor denied her client had recorded the conversation or any conversations between me and him.
In her second letter, I was surprised she stated her client had actually recorded the call and that he had told me so. Not exactly true.

What I find confusing is the significance of his denial of recording it, when actually he was (according to his solicitor) but instead announced a third party was monitoring it per his claim sometime into the call.

Any comments?

Thanks in advance

He shouldn't be recording conversations without telling you - it's illegal. Which is probably why he's denying doing it. But you have no evidence that he is anyway so....?

    And why do you care?

You do not have to inform the other person if you do not share the recording with a third party.

That's only totally true for consumers; if you're a business it's much more complicated and the general advice is that if you're recording a conversation you need to use 'reasonable' methods to inform the caller.

That link simply contradicts what you've said. Clearly not illegal if they're recording it for their own systems/books etc.

Do businesses have to tell me if they are going to record or monitor my phone calls or e-mails?

No. as long as the recording or monitoring is done for one of the above purposes the only obligation on businesses is to inform their own employees. If businesses want to record for any other purpose, such as market research, they will have to obtain your consent.
