Hello, my ex employer is again threatening to sue me for making use of confidential information, before I reply to his solicitors letter I need to know if I could use statements made as part of an employment tribunal process ie: ET1 and ET3 in any proceedings he may bring against me, the employment claim was settled via acas before going into the tribunal.

There is usually wording in a COT3 to prevent you doing that. I would refer back to that document which you signed.
