Hi. We have a couple of employees currently on a 3 day week contract, they have both worked more than 2 years. We want them to do 5 day weeks. Appreciate your help on these questions:
1) what is the process for moving them onto 5 days? Presumably we need consultation meetings etc. how many, who involved etc?
2) How quickly can we do this?
3) If they refuse, do we have to pay redundancy?
4) Would they have a case for constructive dismissal if they refused the 5 days and we dismissed?
Thanks!

Are they good employees? Do you want to lose them?

If they do not want to move to 5 days, the other option is to keep them on and employ someone else for two days.

You can only do this by agreement. If they refuse they are not redundant as you still need the work to be done.

They will not have a case for constructive dismissal if you pay them the correct notice and outstanding holiday pay. They will have a claim for unfair dismissal.

Why not just hire a 4 day/week person?
