EICR IN NEW LEASE

Hi, I own a shop and my lease is due for renewal next year, the property I’m in is over two floors and have had minimal maintenance over the years. All the wiring/fuse boards are old and outdated. No EICR has been done on the property and the electrician has been booked for august by the landlord, my current lease doesn’t mention an EICR and when I spoke to the landlord he complained about having to pay out for one. I have then received a new lease dated to come in to effect on 1/7/24 (8 months before current contract expires) and in the section that I am responsible for this has been inserted “to pay for an Electrical Installation Condition Report every 5
years or when next due for inspection following the owners arrangement” now considering they have booked the electrician for august this would now be my problem. The new lease is unsigned. Does this mean I would have to pay for the report. Or does it mean I would have to pay for all the electrical work that comes after to pass the report as the electrician has already told me the building isn’t up to standard. If any one knows or has been in a similar situation your help would be appropriated. Thank you

If the new lease has been granted under the landlord and tenant act because you're entitled to a new lease then it has to be on the same terms as the old lease so I wouldn't sign anything additional regarding the electrical certificate unless you feel you want to take responsibility for that

I srongly suggest you take your existing lease and the proposed new one to a solicitor who specxialises in commercial leases.

Definitely this - but also try (again) to have a reasoned conversation with the landlord
