Broken promise re salary.

In Feb 12 I was employed as an electrical tester.

At my interview I was told I would be on a lower salary than the other testers until I proved myself. After that my salary would increase to the same as the others. Another guy is in the same boat but a different area.

Despite good performance reviews and the efforts of my supervisor I am still on the original salary.

I spoke to HR six months ago seeking an answer but have had none other than a vague comment about accepting the original contract with no mention of the promised increase.

To make matters worse three other electricians have been employed via an agency and are now permanent staff - and on the higher salary.

My supervisor has since spoken to his line manager who stated, when asked about this, that he saw no problem with my salary being the same as the others. No action however has resulted.

A year has now passed and I am becoming rather resentful and angry.

Given I was told in my interview that my salary would increase ( my present supervisor was present ) are my employers not in breach of contract?

How do I progress without losing my job but getting the money I deserve and was promised ?

It was made clear at the interview however that my salary would increase after the intial trial period.

The manger who interviewed me did not realise how difficult it would be to alter things apparently and he has since left. My supervisor was in the interview and as stated in writing what I was told at the time.

Then it seems you have two options;

1. Insist to your manager/HR that you were told that you should be paid a higher salary after your trail period. Ask the question again then why you are not being paid thus. If they don't do anything about it, visit an employment law solicitor and state your case in their free 30 minute consultation to see what you can legally expect them to do.

2. Consider that the people you currently work for are not very decent and look to find another job elsewhere. If point 2. fails, go back to point 1. and try again.

It's a very common practice unfortunately.
Just make sure that you can get another job if you need to before you kick up a stink. Employers can be needlessly ruthless.

There is two possibilities here. Either a claim for breach of contract, or for misrepresentation.

For the latter you must show there was no intention to ever make good on their promise. The first, therefore, would be easier to establish.

Have heard to day that my claim has passed the first hurdle with only another 3 signatures needed for approval.

Good luck on you. Hope you get the increase that you are seeking for.
Otherwise, better look for greener pasture (don't know if there is any such things around recently).
