Accountant won't return records or produce work

Hello all,

Can I formally complain about an accountant who hasn't produced p60s and VAT info for the past two tax years, and refuses to return our financial records?

My mum runs a catering business. She's employed the same small accountancy firm for the past decade to do her financial stuff like general bookkeeping, VAT etc. She provides her financial records on time to the them. The accountancy firm is headed by a chartered accountant, who is registered with the ICAEW. We don't usually communicate with the chartered accountant, although her name is on letters regarding payment. My mother usually communicates with one of their employees/ agents, let's call her Miss ABC. Miss ABC isn't a chartered account (too thick to pass the professional exams), but she does some of the actual work herself.

Since June 2020, my mother has repeatedly asked Miss ABC for p60s, info on VAT liabilities and a short letter on her net profits. Miss ABC repeatedly tells us that she will get it done "by the end of the month". It's now October and we still don't have any of these documents. Miss ABC won't readily answer her office or personal mobile. I've had to email her recently, only to be met with the same reply. I then requested her to return my mother's financial records, which she refused to do, stating that I could not tell her what to do. I suspect they may be lost or destroyed. I've tried to email the head of the company and have been met with zero response.

I'd really appreciate it anyone can suggest what my next steps should be? My mum urgently needs her financial records returned. She wants to engage a solicitor but I don't think that would be financially prudent.
 
Phone the head of the company.
Pretty much has been impossible! They disconnected their main office phone and the owner has ignored my emails. Phoned their other branch and the man on the phone claimed he couldn't help me at all.

If a method is not working then stop using it.

Complaint letter..

Then go to governing body.

Presuming of course they are a member of some body still.

Your mother should have a letter of engagement which will set out the firm's internal complaints procedure which you should follow first.

If that doesn't produce a result then ICAEW has a complaints procedure which you should follow and is set out here

Looks like we were never given one, that's how bad this firm are. Thank you for the link, will be sending a complaint to them.

They don't even have actual address, just one of those generic address people use to set up companies. Thank feck that the firm is registered with the ICAEW so my mum has some form of recourse. I'm sure they will pretend otherwise.

You should tell that to my mum. What an insufferable bunch they are. I posted the same question on an accountancy forum and everyone got super offended that I called our accountant "thick".

Think at least some of us can come up with words for them that are not thick. Still not complimentary.... :)

Not providing a letter of engagement is in itself a disciplinary matter. Have you checked the individual on the ICAEW website to see if they have a Practising Certificate as they would be another disciplinary matter.
I used to sit on one of the disciplinary panels and the professional bodies do follow up these complaints as "thick" and unprofessional members bring the profession into disrepute.
Only drawback at the moment is that everything is being delayed because of Covid-19.

As others have said, yes, formerly complain to ICEAW, review your engagement letter with the accountancy firm to confirm what contractual obligations the accountant had promised, stop any instalment plans and ask for full refund of instalments relating to services not performed.

However, complaining will not get your books up to date.

Get your Mum to sign up for HMRC Government Gateway for the relevant taxes and business, if she has not done so already, so that you can see exactly what returns and documents are overdue.

If your accountant is using online accounting software, such as Xero, Quickbooks etc, then you may be able to contact the accounting software company direct and demand access to your accounting records.

Whilst you might want to clear any backlog yourself, you may be better to find another accountant who can help perform the task for you as we can collate and analyse the data more efficiently.
We can also help you sign up for VAT Making Tax Digital, if that has not yet happened and we can help set you up on more efficient online accounting software which will give you more control and visibility over your accounts and obligations in future.

Accountants aren't all the same.

Have you checked the ICAEW website to get an address there? Here's a link https://www.icaew.com/about-icaew/find-a-chartered-accountant

I'd send a formal letter of complaint to the director/principal of the practice headed 'complaint' setting out each issue you have, and make it clear what you want done, I'd send the letter using Royal Mail signed for service. Do also ask the firm for details of their complaint procedure.

If you get no response, or aren't satisfied, and have exhausted the complaint procedure I'd get in contact with the ICAEW.

It's so disappointing as an accountant to hear situations like this, as Rebecca at Spur Support Services said accountants aren't all the same.

Just to pick up on that one point; she is right not to return the records to you without any authority from your Mother as your Mother is the client. You Mother either needs to give the firm authority to communicate with you or make the request herself.

First, a gentle chide. Don't ever let things run on this long in business. If you don't get the response you want/need from your accountant very quickly, address matters immediately.

Sadly, you now have an unknown size of issue. No one knows what, if anything, these accountants have done. You are in urgent need of new accountants.

And the current ones will have to release the information to them. If they refuse, get very precise with them indeed. If they won't take phone calls, a firm letter setting out a date by which you need them to comply, and making a formal notice of complaint, would be a good start.

I really hope you get it sorted, and that it doesn't end up costing a fortune.

This is correct. In my comment above, substitute your mum for yourself! But don't let it drag on.
