Hello,

I hope everyone is safe and well at this troubling time.

As I am in the process of setting up an online shop selling eco friendly, uk made beauty products such as deodorant, face creams, beard oils etc. I have questions popping up all over the place that I thought a little help might speed things up.

I am thinking need professional indemnity insurance and or public liability for my online shop due to the nature of the products im going to be selling.

It is an online store only so I wont meet with customers and I assume I need to have insurance even though the makers themselves do too.

Can anyone clarify this for me please.

Stay safe

As far as I know it is not compulsory in English law but very wise. If you have any PAYE employees then you must have employers' liability insurance unless you only employ family, but you may well have no employees particularly if you are a sole trader.

I am not an insurance expert however so may be worth checking with an insurance broker and finding out the cost.

If you supply products which physically damage people they have a choice under consumer protection law of suing the person who sold it to them - you or your limited company as the case may be, the importer into this country, the person whose traade mark is on the product or the manufacturer and you cannot by any contract term exclude that liability - so not surprisingly people are keen to take out insurance.

If you have written terms or contracts with the makers try to ensure those says that the maker will fully indemnify you if people claim against you.
