Market traders licence/ Public liability insurance?

Hi all

I am thinking of selling my plush toys on a stall in various shopping centres. Both a Market traders licence and Public liability insurance have been mentioned by the shopping centres manager as something I would need. My question is, do I need one or both of these things to sell my products in a shopping centre(like the Metro centre)??

Hey,

As licences and insurance policys are completely different concepts then I would imagine that you would require both.

the market traders licence allows you sell from a market stall.

If you are going to sell products you need Public Liability Insurance. Where and how you sell them does not change this fact.

If someone injures themself on one of your products they may well sue you. If you are not a Ltd company then you are personally liable.

It may seem silly that anyone could injure them selves on a plush toy, and indeed it is unlikely. However ridiculous the claim may seem you will have to defend it and that is expensive.

So, yes you need both. They are completely different things.

Become a member of the NMTF and you get the insurance included, accepted at all venues I have ever sold at, markets, large shows and shopping centres.

JPruby, you'd have to contact the council for each Market to purchase the street trading licence. And the NMTF membership with insurance sounds like a good idea. or you could try the craftsman type insurance.

You will find that more and more business sites will start asking for at least public liability before they allow you to set up. This is because public liability insurance protects you, the premises and the public from any cost's that arise due to a claim - if your stall collapses and breaks someone's foot. Another important part is product liability - this protects you if your products causes some kind of injury to a third party.

You could also check out A-N and AIR - they offer insurance for craftspeople. www.a-n.co.uk (the site is fine art oriented but don't worry about that)

What you might need to look into more is EU regulations on any items intended for use by children, since these are toys. Make sure your materials and labelling are up to code. If not you might find the insurance is voided. Have asked a plush seller I know, will come back if she has a link.

I've been on a few other liability insurance threads and a few names keep cropping up which you may want to try which are Hiscox, Ashburnham Insurance, Fortis Insurance and Allianz.

Personally the NMTF sounds good if insurance is included but maybe weigh up their cost with some of the others mentioned here first.

almost right, they need "product liability insurance" Public liability insurance covers liability arising out their negilgent actions, not any fault with the product. Although neither products are legally required, you would be rash to not have them.

On a second point, a Ltd Co does not absolve directors out of responsibility or liability any more. The companies act 2006 (effective 2008) made company directors personally responsible for thier actions.

Does anybody could give ma an advise about business in UK?
I like to sell some used stuff on UK market directly from my home and on some markets in London. What I need in this kind of business?
I have got this kind of information that I need Public liability insurance and market insurance (I have already found Combined Market Traders Insurance Association). From this topic I found that I need also street trading licence but why I need it when I pay for place on market? For this acting I need also to be self employed?
I am new in this country so I would be very glad if you help me even a little.
