Hi please can someone advise? I have been employed for 5 and a half years I am currently on long term sick and have been diagnosed with a disability. My specialist has told me it’s unlikely I will be able to return. The notice period is 2 months. I am currently on ssp. Firstly, is it worth me asking for a settlement agreement/ill health severance package ? The specialist mentioned it would be worth asking my employer. Secondly what pay would I receive for my notice period ? It is a huge decision for me to have to make as I have a well paid good job and I am
So confused about what I may / may not be able to receive. I am under 55. Thanks
 
If you are in a pension scheme and can get ill health retirement, it would probably be quite a reasonable package.

If you are not in a pension scheme and your employer decides to dismiss you due to your inability to fulfill your contract, you should get 2 months at full pay, minimum. However they would be a bit stupid to do that, as you may then have a case for disability discrimination.

You need to seek a meeting with your HR manager or manager to discuss the options, which should include adjusting your current job to make it feasible for you to return.

If they are not amenable to discussion, and you end up resigning, what you get will depend on the wording of your contract, but it will not be more than 2 months at full pay.
