Help Rogue web developer has registered my domain in his name

Hi Guys,

I am having serious trouble with a web developer I had to sack because
  • outsourced my web build to india
  • he was not a web developer but a middle man
  • the web build that was supposed to take eight weeks had taken 8 months and was still not complete.
I have now found out that he has registered his name as the administrative contact and technical contact with Whois/tucows.

'cept from wanting to kill the 'stard I have logged a complaint with SRS who are saying unless I go through the courts there is nothing they can do.

I am now going through Icann but it just seems a bit long winded,
should I sue him even though
  • I can't really afford the legal costs
  • I don't know a legal firm who know about this matter as it is a fairly new area of expertise.
or pay him the outstanding balance as that is the only way to get the domain
  • The domain is my company name
  • he fraudulently registered the name
  • he did a really bad job and I have had to get the job finished else where.
If anyone know of a legal who can help or know what I should be doing next then please let me know.

p.s if you are looking for a web developer do not use Immersive Media.co.uk based in cheam surrey.
 
I'm assuming because you are going to ICANN is because you have a .com. Do you own the .co.uk as well? If so the nominet may be able to help you (it's still going to cost you a packet though).

In reality though, you are pretty much stuffed. He has not broken any laws since he has no doubt paid the registration fee using his credit card. And even if you pay him the money owing you still can't force him to change the registration details.

If he only the admin contact and technical contact?

If this is the case then you may still be the registrant as these are all seperate records. Most companies put themselves as admin and technical contacts as it stops the customer receiving correspondence relating to the management of the domain, which is what you pay your registrar for.

No he is registered at heart internet and with tucows he has left me as the billing contact so there may be something that can be done, any ideas?

Domain Expires 2011 - hopefully got this sorted just waiting for a few things to fall in place.
