hello everyone, I hope someone can help as I am a bit confused and don't know what to do.
Through my kid's school a met one of the mothers and we used to talk as the school gate. She's had a bad start in the Uk so, trying to make friends, I stupidily invited her to my houseat the beginning of July. She told me her problems, I invited her to stay for lunch and after she asked me about our business.
We had an online shop of different groceries, shampoos, etc and we talked anout it. She asked me to show her the products, which I did and as she was pointing out at yhings she liked, I offered them to her for free, as a gift. She took over £100 worth of products including a hair relaxe, shampoos, conditioners, etc.
We closed our shop on 1st August because of poor sales (hence we were happy to give away the products instead of putting them in the bin).
one day, around mid August I bumped into her and start talking. She then tells me she used the haire relaxer and her hair got burnt. She applied it to the lower half of her hair and continue applying it even though it was burning and curling. She told me she had contacted the manufacturer and offered, as a friend, to see what my old distributor suggested. The distributor suggested to contact the manufacturer for they had to assess the condition of her hair. So, after this, I told her, I said how sorry I was for this had been a present and hoped the manufacturer could help.
Come mid September, I receive a letter from this woman saying that she wants compensation because she bougt this product from me and if I do not pay, she would call trading standards. I answer and relate the facts and also add the warnings and instructions on the pack. She did not do a strand test, she used it in bleached hair (she is naturally dark but had two tones of blonde from half way down) and could not use on damaged hair (including dry hair) which hers was. So I asked for proof of purchase or at least, proof of payment and how much she had paid. 3 months later she writes to me saying that the product is faulty and wants £200 in compensation plus a refund of £50 for the purchased product. I answer again to each point she raises and ask again for proof of purchase and attach a list of cost of all the itemsshe got i cluding the hair relaxer which was £24.99. She claims she paid cash.
After another month I now receive a letter from trading standards saying that they have received a claim from a client that paid £50 cash for this product and caused scalp burnt and hair damage and quote the cosmetic products enforcement regulations 2013. They want to see who my supplier is (not a problem) talk to me about my obligations and responsibilities as a distributor and to have an informal talk with me.
So, I don't know what to do because I did not sell to her anything, she did not follow the instructions, she did not tell me when it actually happened and suddenly, she comes up with all these lies. I have not had a shop for 6 months. Can someone help at all, please? Thank you in advance.

Go to the meeting with the product and show them the warnings.

Ask when she brought the product and then point out you had ceased trading before that date.

Trading standards will wave goodbye and it will all be done and dusted.

Write down a letter stating all that you remember since you first met her, include what you remember of her demands after she had left your premises on the initial meeting

Make sure you include all the information they requested, and a sample if you have any left
Either post it or take it and make sure you keep a copy for yourself

Make it clear that you had stopped trading at that time

Irrelevant. If she paid cash, it would say cash on the receipt. No receipt = no purchase. Trading standards can't do jack. Do not admit to giving her the product for free!
I told them it was a gift. She never paid anything. I have made a big mistake. I'm so stressed out. And all this because I stopped helping her with her stuff because she does no speak English and I was getting calls from her almost daily.

Back in 2004 I drove my new Mercedes E into a ditch and wrote it off. (It was a rubbish car anyway!) But it did not drive itself into a ditch, I did that all by my little self! I couldn't take action against Daimler Benz for my stupidity.

She can't complain if she did not read the instructions on the bottle and used too much of the stuff and on bleached hair. How and where and when she obtained the damn stuff is completely irrelevant. If her head had exploded, you would have been liable and would have to pay damages and buy her a new head.

Back in the 70s some daft women tried to sue the makers of 'Gripe Water' when she had to be taken to hospital with alcohol poisoning. It clearly states on the bottle that one spoonful is recommended in cases of indigestion. It was about 4% alcohol. It turned out that she was consuming about seven to ten large bottles of the stuff every day.

As it was, your friend's head didn't explode - more's the pity, you might be tempted to say - but she failed to use the stuff properly. My car, hair relaxer and Gripe Water - all must be used with care, or you'll end up like me - bald!

I would suggest they come and visit you at your convenience especially if they are based a long way away, but tell them you are quite happy to send a email with all the details and history of the events
I have emailed them saying that I would respond by letter but they needed to actually specify details, let me know if there is anything in particular they want addressed in my letter, what are their concerns, the proof that has been presented, as their letter is very, very vague and just asks for an informal meeting to check traceability.
Thank you all for your responses. I appreciate them all.

If this is the case, I'd meet with them. They are just responding to a complaint; you won't be in trouble if things are as you have said they are. :)

Take more control of the situation. Don't wait for them to specify details - tell them exactly what happened. Do it in a very calm, structured letter that is clear with what happened, how you met this woman, what she said, what you said, when you were trading and when you weren't, what she took, what she said when you offered to give them to her for free, the length of time involved before her complaint, the instructions on the products etc etc.

And dig around for as much background info on this woman as you can.

Thank you. I was about to post a very concise letter but I will expand it following your advice. Thank you so much!
