hello everyone, I hope someone can help as I am a bit confused and don't know what to do.
Through my kid's school a met one of the mothers and we used to talk as the school gate. She's had a bad start in the Uk so, trying to make friends, I stupidily invited her to my houseat the beginning of July. She told me her problems, I invited her to stay for lunch and after she asked me about our business.
We had an online shop of different groceries, shampoos, etc and we talked anout it. She asked me to show her the products, which I did and as she was pointing out at yhings she liked, I offered them to her for free, as a gift. She took over £100 worth of products including a hair relaxe, shampoos, conditioners, etc.
We closed our shop on 1st August because of poor sales (hence we were happy to give away the products instead of putting them in the bin).
one day, around mid August I bumped into her and start talking. She then tells me she used the haire relaxer and her hair got burnt. She applied it to the lower half of her hair and continue applying it even though it was burning and curling. She told me she had contacted the manufacturer and offered, as a friend, to see what my old distributor suggested. The distributor suggested to contact the manufacturer for they had to assess the condition of her hair. So, after this, I told her, I said how sorry I was for this had been a present and hoped the manufacturer could help.
Come mid September, I receive a letter from this woman saying that she wants compensation because she bougt this product from me and if I do not pay, she would call trading standards. I answer and relate the facts and also add the warnings and instructions on the pack. She did not do a strand test, she used it in bleached hair (she is naturally dark but had two tones of blonde from half way down) and could not use on damaged hair (including dry hair) which hers was. So I asked for proof of purchase or at least, proof of payment and how much she had paid. 3 months later she writes to me saying that the product is faulty and wants £200 in compensation plus a refund of £50 for the purchased product. I answer again to each point she raises and ask again for proof of purchase and attach a list of cost of all the itemsshe got i cluding the hair relaxer which was £24.99. She claims she paid cash.
After another month I now receive a letter from trading standards saying that they have received a claim from a client that paid £50 cash for this product and caused scalp burnt and hair damage and quote the cosmetic products enforcement regulations 2013. They want to see who my supplier is (not a problem) talk to me about my obligations and responsibilities as a distributor and to have an informal talk with me.
So, I don't know what to do because I did not sell to her anything, she did not follow the instructions, she did not tell me when it actually happened and suddenly, she comes up with all these lies. I have not had a shop for 6 months. Can someone help at all, please? Thank you in advance.
