Does this email enough to confirm the shop is a3

Hello everyone,

I’m seeking advice regarding A3 use.

I made a query to the council regarding the shop if it is under class A1 or A3 and below is reply from the council:

Further to our telephone conservation, to the best of my knowledge, it is my understanding that the current lawful use of the above unit is as an A3 use.

This is based on the fact that the last known use of the property was as a ‘ABC café.’ Although we do not have a planning record specifically relating to the use of the unit, the café is likely to have operated for at least 10 years, given that in 2009 Council received an advertising consent application for the café (Ref. Number). Due to this length of time having elapsed in this use, it would therefore be considered the lawful use of the property.

This use is likely to have primarily revolved around the sale of food and drink to be consumed on the premises which would confirm the use as A3, rather than a A5 takeaway.

Is this email enough to support the shop is class A3 use? Can I cook on-site and serve customer on premises?

Probably yes.

Depending on how much peace of mind you wanted, a retrospective certificate of lawful development, could be applied for, which would give concrete assurance.
