Am I Breaking Any Laws?

Good Evening,

I have a second business takeaway-express . co . uk

People text their orders through to me and then i go and collect, with my sat nav it is linked up to twitter and every time i collect a order i can input a message,

As you can see from the site my messages state the "house number street and amount the order comes too".

I thought as long as i am not identifying the persons name or phone number it would be ok its just the house number and street.

Is this really breaking any laws?

If a person orders and says can you not place our house number up we don't?
 
i got told as long as i am not personally naming someone to that address or giving out personal details i.e. phone number etc it is ok? because anyone could be ordering from that address and the only people that know the people at that address must already be ok knowing their address.

This is a quote from one of the customers in our facebook group

"Just used the new and improved service and am very impressed. Constant updates and a quick delivery with everything as ordered. Add to that the fact that I didn't have to go out in that nasty weather again and it's just about perfect :) Thank you :)"

Which in their under our docs states if they "do not wish to have the house number showing please let us know when you order"

I would not use your service as it is, even if you do not mention names I would not necessarily want people who know my address knowing what I am ordering.

I would use either a) only the postcode as mentioned above or b) an order number

I would just use the road name, but then the problem comes if you have 2/3 in the same street.

I have noticed a loss of customers but then its trying to a even balance as it is a totally new venture,

90% of the orders comes through by text so i am trying to find ways to spend less time on the phone,

We are also trying to get people to use the site more, as we are hoping to franchise each area in the future with a complete back office and the updates are done by email solely to the customer.

It will state on twitter "Ipswich Driver has accepted order number 001 and is on his way to KFC"

But like everything its the cost involved to be able to afford a system like that

I believe Tom Tom have a program where someone in a central office can send orders etc to the drivers sat nav but waiting their response to what the options are with cutting out certain options etc

Agreed - I would do it by area (city) not house and number. If I was a competitor I would be pushing leaflets through them doors - maybe have new ones printed:

Spent £11.99 on Pizza you could of Saved X amount with us

You will need to put something on the website similar to by using this website you agree to our privacy policy and terms and conditions where you will need to mention what data will be used.

So if I ordered a pizza from you then unless I followed you on twitter I wouldn't know that you have just posted my house number and street address to inform everyone that i had just ordered a pizza as i don't tend to read small print when ordering a pizza.

Say my wife also follows you and now not only knows that i have ordered a pizza but also how much I have spent after giving me strict instructions that I can't have pizza as she's on a diet and I have to be on one as well.

So she gets home -we have a blazing row all because a simple sneaky pizza order has been plastered all over tinternet.

Bit far fetched but really if you must just put nicknames up for people you could even make them up without them ever knowing. i.e.

'cunni lingus from bristol has just received our finger lickin special deep cheesey crust'.

Or don't even bother with the town to give you more room for poetic license. i.e.

'No tip Tommy has just received his garlic bread and chips'

'Salad dodger Simon has just received his meat feast with all the trimmings'

'Untrustworthy round heavy machinery Mike has just received his seafood special'

Make it amusing and it will be better than giving out peoples locations, you might even get more followers whether its legal or not doesn't really matter, I know i wouldn't like it.

I do not know, but I would worry about the Data Protection act.

+1 It seems totally wrong to me. I know it's not some dirty secret, but I wouldn't use the service if you're telling the world about what I'm doing... even if it is just an address.

I'm also confused as to why you have a clearly advertised options for "next day delivery" and delivery in "1-3 days".

Are you looking for customers who fancy a curry, but don't mind when it arrives?

Another happy customer tucking into a large Hawaiian pizza with wedge side order in Bedfordshire!

I think this may upset a lot of people the way it's currently structured.

Im not an expert in law but I dont think what your doing illegal as long as the clients are aware of the score etc.

However let me highlight that in a business sense and in this greedy jealous world we live in by advertising your clients addresses as takeaway users and ingesters, you are going to have people harvesting those addresses and manipulating your hardwork and service.

I get maybe 30 flyers for takeaways through my post box every week when I dont have my NO junk email sign up, it became unbearable.

Why dont you just say - User gimbo (if that is their nickname) your delivery is on the way, no-one is going to join and give wrong details if they are goig to use your service, why is it therefore needed that you highlight any address at all.

In your joining instructions recommend that the user makes up a fictional nick name and solely use this nickname to highlight the order is on its way.

You take an order you put it in your sat nav and deliver it . What is all this twitter ballshit . Why do you people insist on putting everything on social Networks sites !!!!
What it is it with some of you people or am I missing something really big here ....

But but, twitter and facebook are lifes essentials, how else will we know what day of the week it is, how cold it is outside or when my freinds have great nights out but don't invite me then put the chuffing pictures up afterwards to show me what i missed- oh and also how much my neigbours have spent on a takeaway...

People these days are a bunch of ***** I would love to be able to put this down in an Educated and conserative way but I find myself surrounded by faceless premadonnas that have no life but wish to convey theirselves in the public eye as if they were famous !!!!!

an extension of the wife scenario, what of those enjoying 'company' that shouldn't be there in a partners absence?

'what were you doing ordering 2 xyz when I left a sandwich in the fridge for you?'

I alerted a big phone company to this issue pre itemised phone bills (and pre blanket mobile phone use) where they sent out a breakdown of calls made and saying how much of a saving a certain plan would have.....the sales lad just didn't understand how at that time showing partners what calls were made was a potential timebomb.

Agree over twitter and facebook, i await the day when people can't help themselves and forget when publishing their every move 'just off for a quickie with xyz behind the pub'..better than 'i'm on the train'

I was thinking of setting up a takeaway delivery service in Ipswich, does anyone know where I might be able to get a decent customer database to post my flyers through???? :D

No idea on the legal side, agree with others that I don't want my details posted on twitter for friends/neighbours to nosy at when I order food, and generally publishing the details of your whole customer base for everyone to see is a bad idea!

As most, Indian, Chinese and Pizza takeaways deliver themselves I'm taking it that this service is mainly for the Mcdonalds / Subway crew.

Not a bad business idea though as Mcdonalds is a favourite hangover cure in my region, its a bit of a free for all when we are all driving to get our Sunday bacon Mcmuffin still pissed (or at least over the alcoholic driving limit) from the night before.

There's been quite a few messages and i appreciate your input, We have now started to just use the road name and place the cost down now.

As we are looking to go nationwide with this i am trying to find a way of having a text number that will hit our orderline email address.

On Tuesday we are having a meeting with Tom Tom to produce a app that our drivers can download and will be able to put in the full address but only show on twitter etc the road name and cost.

Preston Lad - We have been asked by customers if we had contacts in the next day service like City Link Fedex etc to also make our office to be a drop off point and due to having accounts with these companies can provide a cheaper price than a person walking in off the street with one parcel due to volume. (it is on our drop down menu under "our services cont"

JEREMY HAWKE - We started in Feb with just £20.00 and a Facebook page we now have a client base of regulars which is as we stand 395 so i am sorry if you do not approve of this system but it has proven to work in our case, You being a courier company i would of thought you could of seen the concept as a cheap version of tracking? i know theirs some element of trust but i wouldn't give a subbie an parcel not to know where he is, Yes you have a mobile but then you could ring me and i could say yes i am in Glasgow with the parcel when really i am down in Brighton selling the parcel.

Gr9ce - For Takeaway Express Twitter is a cheap way of a tracking system for customers while we get established we are looking at other ways like a customer login area that they can view, We do this because we do not only provide a takeaway service we provide a courier service also.

I changed my location i haven't changed it back because i was in dispute with a former employer but didn't want them to know i was seeing legal advice

We also through about the case if you were having a family gathering not all the family likes the same type of food we had one last night a Chinese and a Indian by ordering through Takeaway Express we call both establishments and place the order for the same time and pick up and deliver at the same time, if you yourselves done it and got them to deliver you can bet your bottom dolla that one would arrive ages before the other

I once finished law school, but now I work in a very drugotsy field, and as a specialist I do not understand the nature of your question? You should be aware that any deal must be accompanied by legal documents!
