Software dispute

I have a small independent company that I have been running for 27 years. I have recently bought some sales software from a known and reputable UK based company and after some lengthy and badly orchestrated importation of information I became convinced that they were actually building the software rather than it being up and running and and fit for use as they had told me from the outset. They have refused to give me contact details of users to disprove my theory and they will not terminate the contract and refund just over £5000 that I paid up-front. I am in discussions with the office of fair trading but has anyone out there had a similar experience or have some advice please?

I wouldn't worry about whether the product is finished or not. If their performance against the terms of your agreement is not satisfactory (and that may or may not be because they are laying the rails as they go), you don't have to go forward with this.

You do need to decide soon, however. The longer you let it go on, the more difficult it will be to extricate yourself.
