Hi, I make a few different plant-based dry food products. I sell in the Uk but have many requests to ship over to the USA. I am confused about what is needed to be able to do this legally. Any advice is appreciated! TIA

You do not need to meet US FDA (or whatever rules), however, not doing so may mean the import is stopped.

The cost of getting approval (if required) probably outweighs the potential returns on a handful of sales.

What regulations do you need to meet?

I think this is what I’m confused about. I’m shipping cacao - I don’t know if I need approval, who by or what regulations need to be met. In terms of selling in the UK everything needed is met.

Hi Lxcacao23, just sharing my thoughts on this as i too was looking into this as im looking to start an import export company in US next year for various confectionery products. Read the FDA site, it tells you what you need to do for exporting to US.

    google access.fda

and since your dealing with ingredients/food you should look up proposition65 to see if any ingredients you use are banned or require the correct labelling.

    google Proposition 65

If your getting lots of requests to ship to US on a wholesale level, maybe sign up to a platform which can take care of the shipping for you and you only need to worry about the UK side of things. E.g FAIRE, Ankorstore. If its retail, then from my experience of selling chocolate on ebay and etsy. I've not once had a single issue with using Royal mail to send chocolate to customers in US.

Lastly, keep me in mind, maybe early next year my new company can help you with this :D
