Apologies for the duplicate posting but thought this may be of interest to those not reading the LEGAL section.
I have posted a few times on content of T&Cs and their vital importance (click my name for a list from the dropdown) . In most cases you don't have an option to not have them, much of the content is required by the regulations. Of course,even in the absence of T&Cs, the law imposes certain implied terms but its dangerous to do business not knowing what they are until a court intepretes and, anyway ,not owning and controlling the basis on which people do business with you.Implied terms, by the waym do not satisfy the regulatory requirement. The biggest risk of not having T&Cs is that you may be subject to the laws of any country in the world ie the home of your buyer (particularly if a consumer buyer) and could suffer adverse foreign judgments simply because you cannot afford a foreign lawyer.
Following enquiries from other forum members, I am just putting the finishing touches to an easy to follow template driven DIY document to help owners of all standard models of e-commerce business (direct, shop window, or via fulfillment consumer sales, business sales, IT and digital services, etc) set up their own T&Cs , privacy statements and jump through all the regulatory issues. In addition to T&C content, where you place them on the site and how you prove people have agreed to them are separate issues also covered by the template we offer. Many T&Cs I see are not binding on customers.
Those taking the service also receive their own online advice file on our platform for personal non-solicitor help in fitting the template together and also,optionally, a solicitors formal advice on the final product.
If you agree to include our mediation clause (requiring any person in dispute with you to seriously try to resolve outside of court-sensible clause anyway) then our price can be subsidised down to only £75 to include one hour of personal online assistance in building up the template. As an option, a solicitor can be referred to review and advise on your completion of the template via your personal advice file at an additional £80 plus VAT.
I also offer an affiliation deal to those members who wish to promote the template on their own websites.
