problems with ex employer

hi there, could anybody help me with this? I left quit work on the 9 august had enuff of the company. had trouble with human resources a while back. allmost left on that occasion, but i stayed after apology etc. i quit my job, and b,cos i owed them holidays they took them back, which they are allowed by my contract. anyway i waited till payday, 10th sep for my wage slip p45. first they were wrong about the amount of hols i taken, secondly the work timesheet says i left a week earlier than i did. payday came no wage slip? no p45? So i wrote hr a letter, asking for these and telling her about all the discrepencies with my holidays? The day after i recieved a letter with my p45 no wage slip, and no mention of the deductions or problems i wrote about. this letter was from hr at the main company? who obviously only knew about my request for p45, no mention of other discrepencies? I then wrote another letter, demanding the calculations or wage slip showing the deductions of holidays? and that they had made mistakes with dates? ive waited since 10 september for these calculations of deductions. And today i got a letter showing me HOW they worked it out, which i already knew, no proof of calculations . can aybody tell me if she can make deductions and not show any proof calculations? also i worked a no of days in august which they took the holidays back from, wouldnt tax and insurance have been deducted also,? if so shoul i still see calculation? I accept im not owed money but surely she should give me proof? i dont trust the lady atall and think she maybe hiding sumthing . plse help me. also in the letter from her today it says, my p45 shows reflects i lft at end of july 2005, because i was paid no money for the month of august and as such i wont get a wage slip??? can she they do this?? hlp plse thnku.

You would need to contact ACAS they are on the web, or ring them and tell them all this and they will tell you where you stand. These people resolve disputes between employer and employee's. They are free and are backed by the government.

Not sure on the information provided whether you may have a claim for constructive dismissal. In any event you should have made a formal grievance against your employer outlining the issues which should be investigated. Whether the way they handled it justifies constructive dismissal is another matter.

Now that you have left there is little you can do other than putting your issues in writing to them ASAP and make clear what you are raising and what you are requesting from them. You can request a copy of your annual leave record

An employer must legally provide an itemised pay statement up to and including the last day of employment. If you did leave at the end of July, why do you require a pay statement for August? However, you did state that you left on 9 Aug 2005 therefore your pay statements should cover up to and including that date.

Your matter has numerous and possibly overlapping issues. If you still feel the matter is not resolved put it in writing to the employer and contact CABx or a local Law Centre if you have one.

Hi Jason,

Since the number of posts was removed from profiles I could not tell you were a first time poster here, I understand your reasons for doing so now you have explained.

There is no limit on the amount of room you have to post, so take as much as you need.

Once you get to know people here you will find that some of them, (who shall remane nameless for now) are more than capable of using 1000 words when 10 will do

I only made my comment as the way you typed the post made it difficult for me to read, hence I stopped reading it and was therefore unable to comment on the subject. I don't know if any others felt the same or not, maybe it's just me

I believe Handsongroup is right - they are obliged to provide you with calculations etc - it does sound alot more indepth - if I were you I'd make a quick call to the CAB to arrange a chat with someone.

As handsongroup states, you shouls have received a payslip upto and including your last day worked.

It sounds as though this wasn't done beacuse the amount of pay due to you was cancelled out by the amount of (alleged) excess holidays taken.

That being said strictly speaking they should have paid you for those days and taken off a pre tax deduction for the same amount. Hence leaving you with a payable balance of nil.

With regards to the holidays taken as many of the posts already say you should take further advice on this matter as you are entitled to an explanation.

P.S. did you give the required notice period as it is unlikely (if it was amonths notice) that you could have used up the smae period as excess holidays.
