Need legal advice on business name registry with companies house

Hi, I'm starting up a company in the UK and trying to register a Business name however it has been rejected due to section 78 of the Medicines Act 1968 which specifically highlights the term 'Chemist', the term I have used in the business name is 'Alchemist' which has an entirely different spelling and definition, what can I do to resolve this with Companies House?

Would it be best to contact a lawyer and would pricing go with this, as I'm low on funding - the company is for a barber business which kicks off in 3months.

Change the name. Register any name you want then use a trading name for your barbers.

As mentioned, the trading name does not need to be the same as the registered name.

Tried to register it with 1ST Choice formation, I wanted the Ltd. name with the term 'Alchemist' but seems they cant differentiate between 'Alchemist' and 'Chemist'.

Would it be best to do it through the Companies house portal directly?

My guess is that an automated system may be in play, as there are hundreds of businesses with alchemist in the name - maybe @Ozzy has a thought!

You could also try registering direct with Companies House.

Hi ya @sefsyndicate - I don't offer registering companies any more (sold that business in 2014) but 1st Choice is one of my clients who use the software I built under efiling.co.uk. (so does pretty much every company formation agent in the country)
Basically you've already been given the right advice, although 1st Choice does have a mechanism in the software they use to submit supporting evidence to Companies House to justify the use of the name - basically it's being triggered incorrectly and you are not trading in the chemistry industry. Call them and they should be able to push this through for you.

Thank you, I will definitely give them a call tomorrow, I did send an email to Companies House explaining my business motives and highlighting the differentiation between 'Alchemist' and 'Chemist'.

Whilst I don't think that will change your specific issue, I would be interested in what they say.

There is already an "alchemist limited", so perhaps it is that instead. You may need to add something to get it through.
