Making a similar item

I have seen a product that I like the look of. A small company make these items up and sell them - both wholesale and in their own retail outfit. Would I be able to sell a similar sort of item that I make up myself? Sorry if it sound vague or would there be any legal problems? Thanks.

There's no copyright on ideas. 'Passing-off' however, is a different matter.

As long as it wasn;t a direct copy because that would just be cheeky! After all lots of people make soaps and most of us get ideas off the net so they all look kind of similar, I guess it would be the same for you.

I think making a similar product is acceptable , the market has alot of "me too" , the problem is always with the name , so if you don't have a similar name , I think you should be okay.

If you can add something unique to your product's design, give it a memorable name and market it hard, you should get all the sales you need and avoid conflict with the other company if you are clever enough at this stage of your development.

Copying someone else's design is dangerous unless you check things properly - otherwise you may infringe another person's design right or be guilty of passing off or trade mark or copyright infringement.

..... and indirect copying can infringe too.

It's impossible to advise correctly without knowing more and doing any necessary research.
