Freelancing using my Limited Company

I have an eCommerce business which I run part-time, alongside my full-time job, however I'm looking to transition into a part-time role within the day job, on a freelance basis.

My question is: can I use my limited company to charge my services, as opposed to being an employee? Also my company isn't registered to offer these particular services.

And if later, as some BBC people found out, HMRC regards you as being an employee of the company rather than contractor...?

People often diss being an employee. It's regular breaks, often agreed hours, holiday pay, pension contribution, sick pay, travel time and travel pay when elsewhere, and can leave the job easily enough.
How much per year extra is all that worth? a few grand at least?

Short answer, no.

Long answer, you (or your employer) don't get to decide if you are an employee or not. HMRC have set criteria for being an employee and criteria for being self employed/contractor. Simply changing from full time to part time (and invoicing through your company) wont change your employment status. If you meet the criteria for being an employee, set out in the link that Skalloway posted then you are an employee.... just a part time one.
