Hi all, i wonder if anyone can give me a bit of advice? I used to run a cafe that was rented on a yearly tennancy basis. During that time one of the machines had a problem and when i telephoned the company for help i was told it was under warranty and someone was sent out.

I never received an invoice and as i wasn't expecting one didn't think anything was amiss.

Fast forward 22 months and having given up the cafe just under a year ago i have received a letter to my home address that is invoiced to the landlords main company (not the company name of the cafe) saying that it is my final notice before county court proceedings.

I feel sick with worry, i don't have the money to pay and never had any intention of not paying a bill. Can they legally do this to me after all this time? I can't understand why when i was still at the cafe for 11 months after the work was carried out i never received any letters?

Who owned the machine?
Did you sign any paperwork when they visited?
Have you tried speaking to them to say it was under warranty at the time?
Who's name is the court paperwork in? ie your name, your landlords, or your old business name? and what was your set up with the landlord?
