I am Company Secretary of a company which has stopped trading and filed to be struck off and advised creditors of the same.
Recntly an ex customer has filed a negligence claim against the company because our insurance company have rejected it because it has arisen after the expiry of the policy. The insurance company were notified of a potential claim in October but it has only come through in April and since the business stopped trading in November, the policy was not renewed in December.
2 Questions
1. Are the insurance company acting lawfully,we could do no more than notify them of a potential claim because that is all it was at the time, or are they playing hardball to avoid a payout.
2. If the claimant was successful, would i be protected under limited liability law or could i be pursued personally.
