Commercial Tenancy advice needed

Hi everyone

I wondered if anyone can be of help?

I have decided to vacate from my Business Premises and have a Licence to Sublet in place already. My Lease expires next year and I want to put in place a 12 month tenancy agreement.

I have a new tenant who is prepared to pay the full years rent up front. I also do not have any form of inventory for my Lease so there is really minimal risk.

I want to put in place a straightforward Tenancy Agreement and not a Lease (given the time it takes, cost, length of term etc). I also let out another property but this is on a month by month basis with a Tenancy-at-will agreement.

What would be the best option in this instance?

The best option would always be to consult a commercial solicitor. Subject to the details on the lease and other factors it MAY be that the best option is to get the landlord to agree to you surrendering the lease and thus end all obligations. The landlord could then agree a new lease with the new tenant with no involvement with you, and no obligation on you.

The problem with sub-letting is that if the new tenant damages the property and then departs, you may be liable to the landlord for any costs incurred.

As @kulture points out getting the landlord to deal direct is your best option, particularly your liability is covered by the rent paid up front.
