can an ex employer withold my P45 ?

Thanks, yes I have asked for it twice in writing along with the outstanding wages they owe me but they havent even replied.....I left on bad terms in a way, I worked at a place for 4 weeks, handed in my notice, they wanted me to work 4 weeks notice but I left after a week, so I expect they feel they are entitled to withhold the payment

If you don't get a P45, simple sign a P46 with your new employer.
Your last payslip should also tell you how much tax you have paid since April.

I spoke to AACS with regards to this exact same question almost. Basically they told me that there is no legal requirement for an employer to give you a P45, its purely a paperwork exercise (speaking as someone who is waiting for the same bit of paper)

They can't withhold your outstanding wages (and accrued untaken holiday which must be paid). You need to write to them asking for the outstanding money. If they don't pay up you need to lodge an ET1 to get your money through the tribunal process.

If the contractual notice period was 4 weeks and he only worked 1, what is the outcome for either side?

If he had only been there 4 weeks, presumably would be in his probation perion, and possibly only subject to a shorter period.
