Bins Contract problem

Hello everyone, thank you for any help in advance.

I have a bin contract for monthly collection through a management company. The company was poor and had to chase for collection every month.
We are well out of contract and last year after them messing up yet again and billing us for weekly collections I cancelled the service.

I have confirmation that they had cancelled the contract. I requested their bin to be collected from our business.
However, they’ve continued to send biffs out to collect and even though we’ve not used the bin as a business other people/businesses/public etc have used the bin and I am being charged for it.
I’ve have told the driver many times I don’t want the bin but he can’t do anything. I’ve contacted biffa direct but they also refuse to remove the bin as I don’t have a contract with them.

I can’t stop people using the bin as it’s on an industrial site of numerous businesses and public use.
The management company say I now have to pay the outstanding bill of £500

Any advice would be grateful

Which management company?

If the bin company, how can they send you a bill for a bin that you do not have a contract for?

    If you don't have a contract with them, how are you liable...?

    Which management company?

    If the bin company, how can they send you a bill for a bin that you do not have a contract for?

    I can’t. It’s in a dead end car park. There’s nowhere for it to go.

    I’ve argued with both the management company and biffs who collects it that I don’t have a contract any longer and have requested the bin to be collect May last year 2023.
    The lock on the bin isn’t secure and even locked it can be pulled open so I can’t even stop people dumping stuff in it. I checked it this week and someone has dumped Mac Donald’s rubbish in it and a bag of tissue and I’m being charged for this.

    Then I would suggest invoicing them for storage and/or giving them notice that if it's not removed within say 14 days, it will be disposed off. Getting a solicitor to issue the notice will likely get their attention.

    Whatever you do, don't pay them.

    @Summersmile - why are you getting stressed about this. It’s not your bin so it’s not your problem. They can send you all the bills they want, you just return them unopened saying it’s not your bin.

    You’re right. He’s threatened to take me to court. So I’ll let him. I have all the emails to him cancelling and his confirmation email that it’s cancelled

    Excellent idea. I would usually not like the conflict but this is ridiculous.

    Hiya! See below:
    1. Send a cease and desist letter: Write to the management company, explaining that you cancelled the contract, have proof, and won’t pay further charges. Tell them to stop contacting you about the £500 and that if they don’t, you’ll report them to Trading Standards for unfair business practices.
    2. Request account closure: In the letter, also ask for written confirmation that your account is closed and the balance cleared.
    3. Contact Trading Standards if needed: If they still don’t stop, contact Trading Standards through your local council.
    This should help get the company to stop. Good luck!
