If it isnt in your contract then it would be difficult to argue. You should also be careful as if this hasnt been declared to the revenue you could be liable to tax! I might keep quiet!
From my experience web design companies are not the best people to discuss SEO with. You need a specialist company for this. Finding a good one isn't always that easy. Look at their client list and see how they rank first.

Sounds like you are doing everything you should be. have you considered google adwords. If you select the right keywords it could be quite cost effective.
From my experience they always have wriggle room in these instances. They probably should have pointed this out but I doubt you will get any joy from them. It will cost too much to pursue.
