Hi guys, I am Eu citizen, I am going to apply for settlement before Brexit deadline 31 Jan 2020. How it looks the whole process on the phone, with scan a chip in EU passport? If I have a caution for shoplift suppose I list it? and what section? Please help me because I want to do it right. The main problem is how the government, home office will treat my application if I had been cautioned by police once?

Thank you in advance
bruce

Ok, now I am more calm about that matter. Do you know when is the best time to apply? How long it takes if I use an app and scan chip in passport? And can I apply after 31 Jan 2020 still?
Also what if my circumstances change now, I am a PAYE and want to apply for a Limited company along with the settlement. So what I suppose to say on the application. Since in reality, I don't have a company yet? Thank you very much
Bruce

I would keep the application simple. Descibe your current situation, not your plans, unless you are asked about your plans. Definitely mention the caution in the section that is relevant. Hiding something like that is more likely to cause problems than the caution itself.

Hi, guys, this is urgent. Please answer ASAP. I checked the gov site about requisites and it says that for application for settlement status you need to say about convictions, but you do not need to mention warnings(cautions). What to do now? I am going to apply today? Suppose I give my causation or not to them?

    If you have criminal convictions
If you’re 18 or over, the Home Office will check you have not committed serious or repeated crimes, and that you do not pose a security threat.

You’ll be asked to declare convictions that appear in your criminal record in the UK or overseas.

You do not need to declare any of the following:

    • convictions that do not need to be disclosed (‘spent convictions’)
    • warnings (‘cautions’)
    • alternatives to prosecution, for example speeding fines
You’ll also be checked against the UK’s crime databases.

You’ll still be eligible for settled or pre-settled status if you’ve only been convicted of a minor crime.

You may still get settled or pre-settled status even if you have other convictions. This will be decided on a case-by-case basis.

If you’ve been to prison, you usually need 5 years’ continuous residence from the day you were released to be considered for settled status.

Is there a Citizens Advice Bureau near you that could help?

There is an incongruity there that makes me laugh!

I am beginning to wonder whether "being literate enough to fill in a form" ought to be made a prerequisite for settled status (it would be nothing compared to what is required of people from outside the EU). "Should I fill in the form according to the instructions" does not seem a sensible question to me.

Is the thread on topic for a business forum?

Just follow the instructions. If it says don't mention cautions then DON'T MENTION CAUTIONS. I doubt if anyone on here has the faintest idea what the application process is like. So just do what it tells you to do.

You need to say about convictions, so make sure you do. Cautions are different to pending convictions so you dont need to mention a caution.
Ok. Thanks. So I do not need to mention cautions. How long it takes to apply, not many days are left till 31 January, the Brexit date. How can I apply if I have no proper mobile, that can detect passport chip, NFC? On mobile I assume it takes not long, isn't it?

    Thanks Bruce

Expect them to be snowed under with applications.
Complex matter so figure months. You have presumably the rest of the year transition period.

Even relatively simple paperwork can take weeks for civil service to deal with.

Hi, I've done quite a few of these applications. If you have been here for over 5 years, you literally have to show you've been here one day for each of those 5 years. If you have been under PAYE they can usually do it automatically because of your National Insurance number. It takes about 10-15 minutes to apply if you don't have anything really strange thrown up, and obviously language difficulties will slow things down, it will help if you have a British friend to give you a hand. We have generally received decisions within 2 to 3 working days by email. You won't receive anything in the post. You do not need to mention cautions and they will not ask you about your future plans. You do need to declare convictions. The most complicated application was my husband's due to him being self-employed etc, his application involved taking pictures of one bank statement from each of the last five years. Or you can use things like council tax letters etc, they give you a list. If you don't have a compatible phone, (if you ask around your friends you're likely to find someone) you can ask at Citizens Advice/local library/local council, they can point you in right direction. Deadline for application is end of this year without a deal, 30 June 2021 with a deal (at the moment) so you have some time, don't panic.

The Citizens Advice Bureau is one of the most useless organisations in the UK. Once upon a time it was good. There were paid staff who were properly qualified and who knew what they were talking about.

Now it's manned by 10,000+ volunteers most of whom know FA. The CAB training for volunteers is more about protecting CAB's reputation and covering their ass. I know several cases where CAB have advised tenants against landlords and their advice is despicable - it's focused on telling tenants how to defraud landlords and not explaining to tenants what their responsibilities are as tenants. It's not balanced advice.

In fact, not only is the advice largely useless, it's often not possible to even get to that advice because CAB are so understaffed. I just went and checked Trustpilot (2 stars for CAB) and there are complaints of people waiting for hours to get through to CAB and giving up in the end.

CAB's incompetence does end there. Several years ago I applied to volunteer at CAB. They were absolutely pathetic - lost the application, lost the second one, didn't reply to the third for a month (and till I chased it), then sent me a boilerplate and forgot about me.... I chased and chased and chased and gave up in the end as I realised some serious rot had set in.

It's a different kind of pathetic to the Princes Trust (who consider themselves so superior that they don't want you if you can't provide a CV, a personal statement, an essay on how you can contribute to their goals etc etc. You need to prove you are worthy enough for them to even look at your application!).

So go to the CAB if you must. But it's a lot simpler, cheaper and more effective to pay a few quid and go get advice from a solicitor.

CAB can be useful. Depends on the quality of individual volunteers / staff though.
    Just like other 'support' places.

Ever dealt with social services professionally? Hit and miss as to whether you get someone waiting to retire or someone who knows what they are doing and works for their client.

Unless you've got an actual criminal record then you've got nothing to worry about
