Some of you may remember our post about a company call Vardis. We have tried to cancel a publication and have been told by one of the managers that we are 3 weeks late to cancel.

We have not signed any contract with them, the pictures they are using in the advert are from our website but can not be used without Microsoft's permission. The text in the add has been ripped off another website (think it was a directory) that we published it on, the add states that we serve 3000 system builders, retailers and wholesalers but infact we serve 30,000.

Can they take any action against us because we are not going to pay for the publication?

Also, can we take any action against them because the information is either wrong or copyrighted?
 
Can they prosecute us for not paying them? The publication is utter rubbish and we are not happy with it.

stand firm, they are just scam artists. They live on fear so do not fear them.

Dont Pay and report to trading standards..also is your site copywrited? if they have taken content from your site without permission they are in breach of copywright..seek advice

Beware of callers purporting to be working for charities.
A Member in Nottinghamwas contacted, supposedlyon behalf of the Foresters Fund for Children, by a company called Vardis, who claimed thatthey had sponsoredthe charity through them in the past and requested further sponsorship.The company declined,asit had not done soand did not wish to sponsor any future ventures. It seems that Vardis are working a scam to obtain money from well-meaning businesses. They have also been recorded on the internet as attempting to get money from businesses for placing adverts in publications when they have declined to do so.

Can anybody prove or show us any evidence that this company is a scam artist?

We are members of the FSB and have contact them for further assistance, we mentioned the responses that we have received here and they told us to come back here and try to gather some evidence.

just do some research on the internet. Get directorship lists from companies house and compare them get their accounts. talk to the journalist that i spoke about etc

They are back again.

We are members of the FSB and there legal team has been notified in April about this situation. They are currently on standby until Vardis contact us again and we were instructed by them to contact our local trading standards and see what they say.

Trading standard were also contacted in April, they are also waiting for Vardis to contact us again.

We were told by the cold caller that we will be charged approx £800 for the publication and it would be distributed to small companies within our area. He also stated that we will not be billed until the end of April (after the publication was released).

We received a bill from them in April demanding payment and to pay within 2 weeks if we wanted to take advantage of the offer. What offer???

We are a small company, we didn't receive any publications from them, we have also checked with other small companies within the area and they have never heard of Vardis either.

What do we do? Should we ignore them? Should we sue them for causes me distress? Should we contact the FSB and Trading Standards and let them handle it?

Hi Have placed an ad with this company also. Now they want more !!! I told em i didnt wanna do it again and they dont listen. So i decided that when they send me the paperwork i am gonna write to them. See how it goes great post glad i found it

Do small business actually get a copy of the magazine? We have not received one yet?

yeah i had one sent to me, but they said that there would be loads issued locally and i havent seen 1 anywhere

Now there really P****** me off!!! Who are Crown Debt Recovery? I've read somewhere on the net that this is the company that they send round to collect out standing debts.

We are now being threatened with a debt recovery team. Any ideas?

You said the fsb legal team are on stand by - is it not time to get them doing something?

I also had Vardis ring me but to date all they have sent me is the artwork proof. My registered office signed for it but there is nothing else with it just the artwork.

I haven't received the information they said they were sending out or anything like that so a little concerned!

I've just spoken to my local trading standards and they don't offer trade to trade advice.. useful!!

Unfortunately Trading Standards are set up for consumer protection. Corporates have to fight it out for ourselves.

I only rang them because the business advice section of the trading standards bit on my local council website gave out the number. And according to the lady I spoke to (who was helpful and has sent the details of Vardis onwards) said that many areas do have trade to trade advice just not my two :)

Mate, stuff that cr*p. Take them to court for the hassle they're causing you. Copyright infringement, Company defamation, anything you can think of! :)

In fact, get group together that have been hit by the company, share the cost burden.

Not a bad idea stuart :) I was thinking of that but am more concerned about the Crown Debt Recovery. If they do come round, they will definately have their heads kick in by our guards (i mean litterally) and leave empty handed but that causes more problems.

We have asked for some evidence that the booklets were distributed but have heard nothing back, we don't believe that the booklets were sent out to anybody but us.

We will contact the FSB again but would like a few answers first.

Well violence wont solve it and openly posting that you will carry out such is plain stupid.

What answers are you hoping to get? Get your priorities straight and get legal onto to to get it sorted -you might never get answers but surely that's better than not getting a ccj and the hassle of trying to get it removed.

No doubt it was a "verbal contract" which if that is so ask for a copy of it under the data protection act.They are legal ound to provide it so that will probably be the last you hear from them.
They seemed to spend most of last year targeting locksmiths hence the reason i have the links above.

Guess who has just rung me? Yep Vardis!! Un believable. I let him do his thing for a bit and then told him that they had already contacted me some time ago and that I wouldn't be doing busy with them. He had the cheek to ask me if I was sure as he was the only person that had my details. I said I was sure and that maybe he should check he was sure. The response "right bye" and he hung up.. obviously not as concerned about the kiddies as he made out!

Hi all...my two peneth worth...Vardis called me a week or so ago. I couldnt be bothered to speak with him so said to send info and the marketer would look at it....surprise no literature but the very unpolite man called again and asked for the Owner, (I didnt fancy sales call so said would transfer call - to partner having lunch!), I asked who was calling and he said vardis, to this I asked what the call was in connection with (I was trying to locate partner so blagging a little time) his nice responce: "I am calling from vardis and i have asked to speak to the OWNER!", well that was me told! It's only my company but wish I'd told him to bugger off initially....partner told him no money in the budget until next year and the responce was to hang up!....lovely company to deal with, i wander if the charity knows of the great bed side manner of vardis!!

I agreed to have a ad placed with their foresters fund magazine, but cancelled after 5 days as I wasn't happy with the circumstances around their initial contact.

They've also had Crown Debt Recovery chasing me for money as they claimed they didn't receive the cancellation notice, (sent on 2 emails, numerous telephone calls and a recorded delivery piece of mail). I've asked a solicitor friend to look at it he advised me to report it to trading standards. I reported it and was told it was a scam, but wasn't given any advice as to how to proceed with the matter. I've replied to them on several occassions about the cancellation, and the fact I now have reason to beleive that the methods used were fraudlent.

They've not responded to me since for some reason :P

Read the links i posted earlier in the thread and you will see that vardis and crown debt are the same person behind it all.
Ask for proof of the contract you "agreed to" You are legally entitled to it.No doubt it was the "verbal contract" thing. You are entitled to this under the data protection act.No doubt they will posture and say they have a recording of it so get a copy of it.
As they claim they haven't received a cancellation notice the onus is now on them to prove you agreed to the contract before they can recover any debt surely ?
I've been through all this crap and as soon as i asked for the proof they disappeared.

Btw i'm no legal expert and only providing advice on what has worked for me and a few others in the past.

As far as i am aware no debt recovery firm can take action without going to court? So dont worry about it.

If these companies are limited; get in contact with Companies House and try to get him struck off as a director. Good luck though, anyone could setup a scam business and get away with it, no government body etc. has the powers to do anything about it: well as far as i know they do... they are silly fines ... phone line scam... £2000 fine, hmm... they made 1/2 million, they are laughing!

Even big trusted businesses are scams, talking of phone lines... the TV ones. Why everyone surprised of blue peter fixing them?
They have always been fixed since they began (not all programmes but most)
... even X Factor is fixed (shock horror! lol)

hi there i also got a phone call from vardis on behalf of the forester fund for children. cold selling advertising i told them in the recorded call that i would like details sent out only (costs proof of company who they where )
and recieved there little booklet rubish. then got invoice for £755.00 shocked i called vardis and they had a crackeld recording
something fishy ?

I've had about 15 phone calls from them today, not one of them did I answer, and then they had the cheek to forward me an email which they sent to another address by mistake!

I'm not answering their calls for a reason....and I think that might just be it ;)

If Vardis and Crown Debt Recovery are one and the same, ask for their consumer credit licence number. If they can't quote it to you then chances are they aren't licenced, let the Office of Fair Trading know about it.
They need category E to chase debts.
