This week has seen a few more underpaid tax cases being won over £20,000 of tax written off this week alone!
If you have a demand for underpaid tax
Stick to your guns, follow our approach, send the letters, do not pay and you win!
Is that right? Should HMRC act in this way?
The simple answer is No.
As their own Tax Payers Charter clearly states and I quote (selected and relevant parts):
From HMRCs Tax Payers Charter
Your Charter Our role
We want to give you a service that is even-handed, accurate and based on mutual trust and respect. We also want to make it as easy as we can for you to get things right.
Help and support you to get things right
We want to give you as much certainty as we can that you are paying or claiming the right amount.
We will:
process the information you give us as quickly and accurately as we can
put mistakes right as soon as we can.
Treat you even-handedly
We will be even-handed in the way we deal with you. We will take into account your circumstances and provide a consistent service.

Now clearly HMRC have thrown this Charter out of the window in their handling of the PAYE underpayments.
HMRC shame on you!
So whilst HMRC continue to act in this manner my advice to all those with demands for underpaid tax is .
DO NOT give up and pay the tax.
Follow our approach but be patient!

- All of them had to go to stage 2 complaint letter.
- All of them took several weeks / months to resolve.
