VAT and GST on goods sold from UK to Jersey

When making a B2B sale from UK to Jersey, I understand that the sale is zero-rated for UK VAT, but the courier is charging a fee for 'Local VAT' - if I pay this, which box on the VAT return should it be posted to - or should I choose the option for the recipient to cover the charges? (would they expect this, or be surprised?)

Full time to part time working

Hello - hoping someone can give me some advice
I am a full time working company director with two main partners. My brother has recently had a heart transplant which has made me decide to work part time from June 2023
My salary is currently £5000 a month which is approx £1150 a week.
If I worked 3 days a week I assumed my new salary would be calculated at 3/5 of my current salary so expected to receive £690 a week

One of my partners works over 65 hours a week and the other works 55. This is because they love work and refuse to employ anyone to help them with their work load
When the complany started 25 years ago I also used to work the same number of hours but now i can get my work done in 45 hours a week

The problem I would like advice on is that my partners are suggesting that when I go part time I should be paid based on what their hourly rate is
my pay would therefore be £1150 / 55 hours multiplied by 27 hours (this being 3 x 9 hour days) = £565 a week
Is this legal ?

Importing from India

Hi,

I am completely new to importing goods, and in the process of setting up my business. Apologies if this comes across as a basic question. Google is confusing me further and I've been unable to find direct answers in any of the other posts on here so thought I'd throw my confusion out there and hope someone can help clear it up for me.

I'm looking to import from India, I already have my EORI number. The company I'm ordering from states their shipping costs cover C&F only, Q1. should this be CIF? all I can find on the internet is in reference to CIF, should I be seeking the insurance factor myself? Q2. Their website also states that they are not responsible for customs charges / forwarders handling cost etc. (this I understand) What I'm not sure of however, is that upon googleing, CIF appears to just get the product to the destination port. Does this mean I need to organise forwarding or does their shipping include getting the item to my address once I've paid the customs charges?

Payroll question

Hey guys,

New here so apologise if my question is somewhat stupid, or I’m missing something among the jargon when reading online.

Basically, I’ve taken over my dads business and he uses his accountant for payroll among the employees of his company. Now he pays the accountant gross pay for each employee and the accountant then pays the net pay (employees confirm this) so I’m assuming they are taking income tax and NI to pay hmrc. However, looking into his paperwork, I can see that his accountants send him a monthly statement requiring payment for taxes due on each individual employee.

So effectively, two lots of tax and NI are being paid. First, taken out of gross pay, secondly sending a bill for it to be paid. Is this correct? Or are they fobbing him off and pocketing one lot of deductions?

I know the very basics of VAT and income tax from spending many years as a sole trader, but not as a director of a business, but that really doesn’t seem right?!

They also charge me both employers and employees NI and my dad claims that any profits made, the accountants seem to take it? (I haven’t pressed on this statement as my dad does have a habit of half ass explaining himself, so until I see that for myself, I’m assuming his overly exaggerating.)

Disclaimed property during bankruptcy

During my bankruptcy a few years ago (discharged) the TIB wrote to me saying they were ‘disclaiming’ interest in a second property I own (presumably bc it was close to negative equity). I wrongly thought I could just keep it and eventually sell. I tried recently and it appears the lease has effectively been extinguished and I no longer own it. I’ve sought advice and am told that a vesting order could have been applied for within three months of the Disclaimer, but not now as too much time has passed. A number of questions arise about what to do next:

1. Mortgage. What to do about the £95k charge on the property? Do the lender know? What if I stop paying? If their charge is no longer secured against my non-existent lease, what happens? I haven’t told the lender as that may start a chain reaction outside my control.
2. I continued to rent it out and pay the mortgage, ground rent and service charges for a couple of years. That’s a lot of money. If my ownership was extinguished, I’d like it back.
3. It’s costing me ~£800pcm with interest rates as they are. Should I have just walked away?
4. I’ve been invited by solicitor to get the opinion of counsel which I obviously can’t afford.

This is a bit of a desperate situation so any thoughts would be most welcome! Thanks in advance.

codicil

HI

Is there any solicitor / lawyer that can advise the correct wording for a codicil to my will. I will be making changes to my will but I cannot get a solictor/lawyer appoitnemnt until April

I need to make an urgent change to remove and replace a guardian and to change two of the trustees I have opening part with my name address and decalration that this is the first codicil to my last will etc.

Just some help with a form of words. I can make something up but if there is some useful boiler template for the above two that would be helpful.

Shipping books & magazines from USA

Hi

Since USPS stopped shipping surface, it's been stupid expensive to get books etc shipped (because so heavy for the value).

Anyone know any good solutions? This would be occasional, maybe once a year. If the magazine bit picks up it might become quarterly.

I'd be looking to order from a US supplier and have the courier collect, then ship surface to me here in the UK.

There must be thousands of such outfits - wondered if anyone has any tried and tested to suggest.

Picking a mentor

Good afternoon everyone,

I'm not really sure what sort of thought process should go behind asking this question, so I'm just going to ask it in a vague way which allows hopefully some form of discussion to form.
How do you go about choosing a mentor when it comes to business? I know people suggest getting investors who know the industry you're in, so that you can grow the business with them involved. Realistically, I'm just looking for someone who's made their millions and have been there, done that, who has the capability and the patience to help nurture what I've achieved so far. That sort of person I'm not sure how to find or approach?

I'm a 30 year old who works full time in the Royal Air Force, with a lot of mental baggage (I suffered with severe depression, something that I refuse to now keep me down) and a past that I'm attempting to rectify (ex gambler but now all is behind me). I don't want to get too deep so I can message people privately if they're interested in speaking with me more, but the question here is obviously business related.
I own 85% of a business built in sports memorabilia memorabilia that I started myself, before bringing some investors in that work full time to help me with the business.

Year 1, I turned over £25,000 with a net profit of £500.
Year 2, I turned over £353,000 with a net loss of £60,000 (subsidised with a couple of loans)(my financial years are June-June).
Year 3, I am hoping to break even or again achieve a profit, but I'm a little concerned that I've bitten off more than I can chew. I've no doubt that being nervous about the amount of money flowing is a good thing, but I have a bit of anxiety on whether I'm doing the right things. We have almost finished building a website, with approximately £100,000 worth of stock to push through and sell.

There are varying reasons why Year 2 was a bit out of sync, but essentially I probably looked at expansion a bit too soon and it nearly got away from me.

I believe in the business model that I have, but I think because I started the business with absolutely nothing but ambition and hard work (I had literally ZERO business experience or awareness), there's likely better ways to go about what I'm doing. I've also made some absolutely catastrophic errors, which has led me into holes that I've struggled to get out of.

I'm looking to grow the business again under the guidance(hopefully) of someone who's been there and done it, to the point where I can actually afford to leave the military. It's taught me a lot of fundamental skills that I've used inside my business, but I think I'm at a stage now where I'm desperately needing to turn for advice.

Sorry if this statement is a bit all over the place and if it seems a bit like a plea - I probably need to learn how to pitch too!!!

Lazy electrician 4 months and not finished but sends a bill

The guy was asked to do an electrical inspection for me at 4 small retail shops, around 1st week in October he called at 1shop for a short while did not complete the job and despite numerous attempts to get him to
Finish the work he has just been making excuses, end of December
I told him if he can't do the work I would have to find someone else as the building insurance company needs the inspection done.
He promised to complete by end of January but never
Came.

I have kept all the email promises, He made

He has not sent any report or estimates regarding the work
Only his invoice for £150 after I told him I have to get someone else to do the job I said I would not pay it as he has not completed the work in 4 months.
I now have a letter from a solicitor saying pay in 7 days or court proceedings will be issued.
Am I in the right to refuse to pay if I am not I will pay him.
What is your view. Thank you.

Deed mentions consideration?

Hi

I know a contract by deed doesn't require consideration.

Here we have a deed of pledge that opens with
In consideration for the Company entering into the Primary Contract, Y pledges as security for X's obligations to the Company [goods pledged]

My question is:
Would the contract fail for lack of consideration even though it's a deed - because consideration is mentioned?

Or does the reference to consideration just drop out, because a deed doesn't require it?

New Director

I am a newly appointed Director and I have asked to see some minutes from two previous board meetings. I have contacted the company secretary who tells me the other Directors have decided that I can only see minutes from meetings after my appointment.
I was under the impression that a Director can see minutes from any previous meeting. Any thoughts?

I can't receive money from Barclays bank

Hello, I'm new here. I started a digital media marketing company a month ago and I serve clients living in the UK. I have a website that shows the services I provide.

Today I noticed that the money sent by my customers using Barclays is not reaching my company account. I guess the bank can't verify that I'm a business. I have two different business digital banks but have the same problem with both. Barclays dont send money to my business accounts.

How can I solve this issue?

Message from one of my clients using Barclays:
"the bank is making a lot of enquiries. they say they don’t see any your company offering marketing services.they checked online…. asked me where the company is based, why am ı paying, what am ı selling… so much.. and somehow made them cancel the transaction."

Help needed - bad results with LinkedIn post views

First of all, I need to say that I am still quite new at posting on LinkedIn.

We have recently written a post on LinkedIn that I reshared with my comments and some relevant hashtags for my customers.

It was the first time where I had included hashtags in a post.
The total number of followers of these hashtags is 180 000 so I was expecting a good impression results, at least a few thousands.

After 3 days, I only had 150 impressions.

What did go wrong?

Subcontract Advice Please

Myself and a number of colleagues are having problems getting our employer to issue the payment rates for our jobs. These vary from surveys to network checks, partial and full installations. However the Team Manager for our area has been asked on multiple occasions by myself and other engineers to let us have these, he reads the messages and then just doesn't respond.

Is there an area of employment law we can use to leverage this information from him/his company or do we need to try and push it higher?

How to switch from director to sole trader?

I have been teaching Yoga and charging clients as a limited company of which I'm half shareholder and director for 6 years.
I would like to switch to sole trader.
What are the steps involved?

1. my company has a business bank account
2. I have been filing self-assessment with HMRC every year. My revenues were always small and so never had to pay tax on either the company nor on my director salary.
3. I have missed NI contributions over these years.

Advice: Supplier refuses to accept responsibility for broken item

HI everyone,
I wonder if anyone can offer some advice please.

I run a small interior design consultancy. For one of my clients I ordered a composite bath (£4000). It was delivered in a crate, without the feet and before it was ready for install so it was put into a garage for storage, still in all the packing. Now that it is ready for install, the crate was opened and I discovered the item is completely shattered - it was clearly dropped very forcefully at some point before being delivered to me.

I contacted the supplier and they say that I had 48 hours to note any discrepancies so the liability lies with me.

Can anyone suggest any legal basis for pushing back against this? The item was clearly broken on their side, whoever did it would have known, but I feel like they are trying to shift the cost onto me! Is this legal? They clearly delivered me a broken product, it's just that it took me a few weeks to open the crate to discover it.

Insurance required for web service

Hi All, we have just registered a limited company to launch a new web service for professional musicians to list them in an online directory where they can find work more easily. I'm wondering if you know what kind of insurance we must have or recommended to have for this business? Question for Bridal Studios

Hi all, I have a quick question about the Bridal Outfitter space.

I currently offer an advertising service to shops like these, however my offer of booking more appointments doesn't seem to be resonating quite well / owners just don't seem that interested in this.

Sure, this could be for any number of reasons - not least of which that my primary outreach method is ringing them up directly, certainly something that no one likes - but I have an inkling that '10 new appointments per month' just don't seem to be a primary desire for bridal studios?

Course is Free, Certificate costs - Does this count as a tax free expense?

Hi,

An employee has submitted a claim to be reimbursed for a training certificate that they have paid for and they expect it to be treated as a tax free expense.

Course:

Relevant to role / Free / Course provider and certification service are not registered on the ofqual/gov website.

The cost is due to the certificate evidence itself, and 3 options were provided:

Option 1 - Digital diploma / Option 2 - PDF + Print / Option 3 - PDF + Framed Print

The employee chose option 2 which was more expensive than option 1.

Concerns:

Not registered on ofqual/gov website
Free course, yet paying for the certificate, and certificate may not have been necessary if another way to provide evidence of passing (we have a screenshot of them passing the course and the website suggesting they should pay for a certificate to 'highlight skills to potential employers').

I've been told that the managers approved it, but that doesnt concern me, I just want to know how HMRC would expect us to treat this payment.

Should we be treating this as a tax free expense, when the course itself was free and the employee chose to pay for the certificate?

No sales - do I need to file a corp tax return?

Hi,

I opened a business back in December 2021 and HMRC is requesting I complete a tax return.

I'd rather not procure the services of an accountant given I haven't made any sales through the company.

The only thing I've used this company for is to invest funds loaned to it from another company. Those funds remain invested and nothing has been executed if it were.

Any advice?
