Trademark Application - Series Application

Hello,

Having read a reasonable amount on the subject, I have decided to register a series trademark for our new brand. Our intention is to apply for a series trademark using which will consist of a single word (a word we have created and I feel has good potential for a successful registration) using both lower and upper case letters. I have also identified a single class for the registration.

My question is this, having started to apply online, I reach a section asking me to 'select terms to add to my application' - there are literally hundreds. Are there any drawbacks by 'selecting all'? Do you have to select any terms at all and if I don't will my registration just show the generic class description?

Hi Chris - you need to select terms for your application to cover, you can't just leave that section blank.

You should think carefully before filing too broadly. You need to have a bone fide intention to use your mark for all of the goods and services that you select. Also bear in mind that the broader your application the more likely you are to come into conflict with an existing third party trade mark registration.

Hi there.

Thank you for your reply. When looking at competitors' registered trademarks within the same class that I am interested in, the list of goods is simply declared as the generic list attributed to the class description. For example, 'Clothing, Footwear, Headwear' as opposed potentially tens or hundreds of more specific items. Would I be better going with this broad definition? If so, do I do this by selecting the 'Select class and enter manually'?

If that broad description encapsulates everything that you are planning to offer under the mark then yes you can use it as opposed to specifying each individual item that you plan to sell. It's been a little while since I filled one of the application forms in but I would have the goods/services section reading 'Clothing; footwear; headgear'.
