Suing RBC for sending bailiffs

There is no CCJ just the council has employed CDER and they said the court awarded them a warrant
In which case you will have been issued with a copy of the warrant. Next time they come knocking ask to see but do not touch the warrant.

I have to say looking at CDER's website they look like local authority approved thugs - not sure that what they write on their site is within the spirit of the rules re bailiffs even if it doesn't breach the rules.

They keep saying if you don't pay they will get an arrest warrant then say this to scare people

"CDER Arrest Officers can arrest you anywhere in England and Wales. This can be are your home, your place of employment, at friends and neighbours, the corner shop, your children’s school or the local pub.

Arrest Officers will make every effort to be discreet and avoid sensitive locations for arrest however if you consistently refuse to engage with us to resolve the matter, they are required to arrest you on sight regardless of location."


I cant remember hearing of civilian bailiffs arresting people for non payment of parking fines !!!

Also as bailiffs can't visit you in working hours (think 9-5.30) they say this failing to mention that window in the middle they won't visit

When will the Enforcement Agent attend my property?

Enforcement Agents may conduct visits between the hours of 6am and 9pm daily.

I think he did mention that he kept saying my car will one day be gone. We work off the element of surprise

My neighbour said anything she’s got she’s put in my letter box. I honestly don’t know if I believe her. If I knew I would of got legal advice straight away so she either didn’t check and put it in the bin or she saw them and put them in the bin.

People love to be outraged by bailiffs, HCEOs and the like - usually up to the point when they are the creditor, then suddenly it all becomes fair.

Statistically it's unlikely - but not impossible - that they broke the law, or even stretched it. Their badge is at stake if they do so. They probably had body cam, which would be revealing.

In this case however, we are hampered by chunks of missing information, so can't give meaningful advice

I know they have tried bully boy stuff with me before the same officer put a clamp on my car during 2nd lockdown December 2020. I won with the courts as it was sent to an old address. It’s possible they have possible it was posted or the annex flat C but those letters we’re all returned to sender.

    That's got to be illegal, surely? Bailiffs, even High Court Enforcement Officers have no powers of arrest whatsoever. Only police officers do, and a bailiff will only call them if the debtor threatens violence or obstructs them.

    Likewise, OP, the "warrant" that the bailiff has is highly, highly unlikely to be a court granted warrant to enter your home.
