Sublet clauses

Hi,

I am a tenant of a commercial lease for an industrial building, I have some spare space.

My lease states I can not sublet.

However, I am allowed to charge customers for storage space. I was just wondering what actually is the difference.

I am allowed to split the unit into, say 10, different areas and charge each for storage but I can’t sublet.

In a nutshell I want to allow people to use some of my space for their own businesses but I don’t want to get in trouble too.
Instead of creating a sublease; if I became a partner (on paper only) of the company that I intended to “sublet to”, then I believe that would be ok?

It's rather odd that you cannot sublet but you can rent out storage space- so presumably you can create personal licences to your customers so that they can park or store goods on your premises but you cannot grant any interest in your premises that would amount to a sub-lease ie., an interest in parts of your land or premises.

The best thing is to clear up matters with your lessor - better late than never.

    You are trying to break the terms of your lease. Don't unless you have watertight paid for legal advice that states that you can.

    If you don't understand the difference between letting out storage space and sub-letting (in the teeth of the lease) for people to run a business, you should not be considering dealing with this issue without legal advice.

    As above you really need to talk to your landlord and seek permission as this is a change to your lease. You say you have or going to split the area into ten separate units for storage has the landlord actually approved plans for this in writing ?
