Sub Contractors & insurance

Hi

I am moving from Sole Trader over to a Limited company.

I have a sub contractor, and I'm wondering if I need to cover him under my insurance?

As en employer you will need employers liability insurance. If he gets injured whilst doing work for you or on your behalf and he is off work you are liable/open to a claim. (it is law that you have this if you employ anyone other than yourself)

You should ask him to get Public Liability insurance for. If he damges anything on a customers premisies through his neglignece. The customer will claim off you and you should claim of him (It is not law that he has this)

The sub-contractor is a Sole trader, and he has his own clients

If I need an extra pair of hands, we works for me and visits client sites doing PC work.

I don't supply his tools, pay his travel or anything like that. I just pay him per hour.

You can be very exposed if he causes damage to a client of yours. You need:-

1. Professional Indemnity cover for work done for your clients whether by you or your sub-contractor.

2. Ensure he has adequate PI cover as well.

3. Ensure you have solid Terms and Conditions in a contract for your client work that limits your liability and covers a host of other issues.

4. Ensure you have a protocol that ensures your clienst are fully bound by your T&Cs (easily overlooked eg by sending T&Cs after the contract of work has been entered into and thus when not binding).

5. Ensure you have a solid contract with your sub-contractor giving you a full indemnity by him against all claism that may be made against you by your clients and a host of other matters.

6. Ensure when your Ltd Co is formed that you comply with the Companies (Trading Disclosure) Regs 2008 ie display on your website and all business emails (and letters ) your ltd company name (with word ltd) your company registration number, your Registered Office (and designate it as such) and state that it is registered in Engalnd and Wales.

Your current website is unlawful for not identifying who is "|Computer Blues" but I assume you will put this right when you carry out 5
