Hi All,
I'll try and keep this to the point.
Got taken to court, even though I'd offered refund.
Customer refused to send or allow collection of goods.
We end up in court and judge awards her 30% less than I originally offered and no court costs.
I had to pay because she had confirmed order electronically and I didn't send t&C's in this format. I had given them to her face to face at her property but the law doesn't see that.
I paid her what the court ordered within 14 days so I wouldn't get a CCJ to mine or my companies name. She has accepted receipt of the monies.
I sent boxes via courier to collect the goods. She refused to put the goods in the box for the courier stating she would only accept collection after 6pm on a weekday or at the weekend after 1pm.
So I've paid her, she's got the goods and to boot, she's gone all over Facebook on loads of public groups running me down.
What can I do?

If she is local I would ask her which day, drive around that evening and collect the goods whilst stood in front of my vehicle with it's dashcam conveniently recording.

If she fails to give, immediately take her straight to small claims for the value of the goods using all the prior comms and video as evidence

Go collect yourself.

Organise a collection at her convenience.

Walk away, forget about it and move on.

Thing is I think she'd have me locked up for threatening behaviour or some bs. I suppose the dashcam footage would show a story. That's why I didn't want to meet her face to face - she's threatened me over the phone.

She does not need to know you are you and not the courier/delivery driver if you don't tell her

I used to go by motorcycle in leathers to collect cheques for outstanding payments, most just assumed i was a courier. The time one tried it on with a different story when i arrived to what they had said on the phone we just detailed it in the letter before action and the payment inc penalty charges was very quickly forthcoming.

People often see the clothes not the man beneath !!
