Sick pay during probation

Hi everyone,

I have (had) an employee who was in her probation period, took 3 days sick last week (Mon, Tues, Weds), then put her notice in on Thursday.

It doesn't specifically say whether or not we pay sick pay during probation, so I was wondering if we need to pay her for these days?

Hi,

Do you only pay stautory sick pay? If yes, then your employees will be entitled to this during their probationary period. If you have company sick pay which is higher, then as part of the probationary period you could state that they are not entitiled to company sick pay until they have passed probation.

The best thing for you to do is, state clearly in your contract what the sick pay procedure is during and after probation.

If it's only three days sick, she won't qualify for SSP, so the only issue is what your contract does or doesn't say about contractual sick pay. You mention it "doesn't specifically say" - what does that mean? What are the terms?
