Selling replica football tshirts and it's legality...

I cam get some really nice footy shirts which are very realistic, is there any way I could sell them?? Eg saying there fake or anything?

You will need a letter of authority from the designer them self or wholesaler to re-sale bought goods.

If you purchase from a wholesaler also check with the designer to see if the letter of authority is real.

Without a license (which I am sure you probably would not get without investing a LOT of money) you cannot do anything that mwntions the brands (teams).

Unless the manufacturer has a license from the football clubs (which obviously they don't given the shirts are fake) they are infringing the teams trademark (and possibly copyright too) and so would you be if you sold on these items. Putting up a notice admitting that the shirts are fake would just be making matters worse.

I wanted to know the legality of selling whilst informing the buyer that its not original, whilst you may be an established business operator, im only starting and im 18, and asking a question isnt going to kill anyone, so yes I am for real, and I would still standby my question...

I just came back from Peshceira in Italy by Lake Garda. I was at a market one day and the stall selling the replica shirts was the busiest. I bought two for 24 euro .No discount and there was a queue to buy them

Thankfully in this country, unlike almost every other country, we actually believe in trade mark protection and try and uphold it. The OP WILL get caught, WILL have his stock impounded and WILL be prosecuted. All it takes is one phone call from any of his competitors trying to make a living legally - or any of his customers who have realised they have a cheap forgery

As mentioned it only takes one call, Trading Standards responded to a trader stood next to myself in under an hour on a large show five years ago, the guy selling the snide gear lost all his stock, and did some time.

No offence but anyone doing this deserves all they get, stick with legit gear, it's harder to sell but you don't have to look over your shoulder all the time.

I will admit, some of the fakes look incredibly good. But heed the warnings, you can go to prison for this, even if you're just selling at car boot sales!

You're correct, I bought one many moons ago not realising it was fake until someone spotted the spelling on the shirt.

It was a Real Madrid with Luís Figo written on the back, however what I never noticed due to my stupidity was that it actually spelt Figo as "FICO" you can imagine the slaggings I got from fell football fans!

i;v been on the side of this where i paid for a website to be done for my printinting and embroidery business, bought on ebay and when it was sent through to me it contained images of postman pat, simpsons and loads of other copywrited images so was completely useless to me, fellow who done the design was brilliant at the time and made the site within 7 days then went ahead and put a link on his ebay listing to my site showing all these images, i have never been so worried so spoke to another customer of his who said he was closing his business as the copyright holders were chasing him for £5000 for damages, as usual ebay did not want to know so i had to scrap my website before it went live.
you have to be soooooo careful these days

As a person who does sell football memorabilia I looked into selling replica shirt some five years ago. The upshot then was if I wanted to sell lagit back then I would have needed to invest something like £25k !!

Yet almost everyday I see sites and people selling these things it really does piss me off.

I guess a lot has changed in five years.
