Register a company - Name in Administration

Hi guys,

Hope you're all having a good Sunday. I want to register my first company and I have a name I REALLY want.

The problem is, its taken, but the company that owns it is in adminisitration. It has "R" status which means Other insolvency type. These are the details of the company:

Status: In Administration
Last Accounts Made Up To: 12/2009 (FULL)
Next Accounts Due: 09/2011 OVERDUE
Last Return Made Up To: 06/2011
Next Return Due: 07/2012 OVERDUE

My question is, can I now register a company with that name, or do I have to wait for the name to become dissolved. If that is the case, how long do I have to wait for that.

I've tried googling this without a lot of luck so any help would be awesome.

I believe you have to wait for it to be dissolved, as there is still a chance someone will buy the company and then carry on using the trading name. Or in some cases the trading name can be sold as an asset of the business.

Ok, ive signed up for updates on companies house for the company, but what kind of time frames are we talking here until the company becomes dissolved assuming it sisnt bought.

Really depends on how complicated the Administration is, could be weeks, months or years. Best bet is to find out which firm is doing the work and ask them.

May be a silly question but why would you want to use a business name for a firm which has gone into Administration possibly owing people money ?

You definitely have to wait for it to be dissolved, CH won't allow a new name to be registered that's identical to that name already registered.
You could put (UK) or something at the end of it to get the name and then change it once it's dissolved.

As has been said countless times, if you take on a name of a previous firm, none the people who were caught out by the old firm will believe that you had nothing to do with the other firm and will chase you for debts and you will inherit their bad reputation.

Do not go down that route. Think of another name.

If, after reading everything here, you still wanted to buy the name, you could approach the administrators and make them an offer. You could offer to buy the actual company name, which would involve having to do a formal name-swap, which might be quite costly in legal fees etc; or you could simply offer to buy the "non-limited" part of the name, and use that as the trading name of your company. It's the trading name you want, rather than the company name, I suspect.
