Recruitment Agency Question

I recently interviewed someone who was introduced to me through a recruitment agency. The candidate is suitable however I don't want to fork out the huge fees I would have to pay up front to the agency on day 1 if I took the person on.

I haven't signed any t&c's although they were emailed to me on initial contact. If took on this candidate without telling the agency what is the worst case scenario if they find out?

The candidate also did not sign anything.

Both my company and candidate were randomly contacted by the agency with the no initial contact from us.

    How would you feel if someone ordered your goods or services and then decided then didn't want to pay for them but went ahead and used them?

    Why get into discussions with an agency if you didn't want to pay their fees?

    Why interview the candidate an agency put forward if you didn't want to pay your fees?

    It doesn't matter who contacted who - you decided to use their services, you had their terms and conditions so knew what your liability was - so pay for them.

    If you don't want to pay find your own candidate.

    You were aware of the agency terms before interviewing the candidate, so you should do the right thing and pay for the services received.
    You wouldn't have to pay the fee on day 1, just within the agreed payment terms.

    The terms are likely to have a clause that states the acceptance of an interview with the candidate is acceptance of the terms.

    It's also worth mentioning that if you don't inform the agency of the offer of employment, the candidate starts and then leaves within a week or two, you will still be liable for the full fee.

    You only receive a rebate/replacement if;
    1) Informed the agency of the offer.
    2) Fee paid within the agreed payment terms.

    Didn`t want to create new topic. Example: company is looking for project manager on their construction site on contract, agency finds one. He gets paid every week by agency. What is agencies margin? 25%?

    How much company will pay agency if that person wants to join company as permanent employee?

    OP, what you are suggesting here is illegal, immoral and unethical. If I were an employee looking for a job you would not be the first person I would want to work with. However, your prospective candidate is also prepared to act illegally, immorally and unethically. If I were an employer looking for staff they would not be the first person I would want to work with. Perhaps you deserve each other.

    In the future, when you breach their employment contract, or they shaft you by taking your clients to a new employer, please don't be surprised.
