Hello all, just popping in to update you.

We have repeatedly asked for details of the PI insurers and have not been provided with them. My belief was that this was due to the firm planning to settle without notifying their insurers.

There has been some progress. We received a settlement offer for a significant sum a week or so ago, but not at an acceptable level. So we've gone back with a counter-offer.

If they don't accept your counter-offer inviite them to use Smartsettle - see 5 mn video of how it works to help quickly and fairly settle any dispute over how much to settle at.

See also this news story of how it settled within an hour a case that was headin for a final heariing in curt and failed court mediation,

I'm an advisor to the company and can set this up if both sides agree.

Have you made a Part 36 Offer to them, and if not why not? This provides such strong advantages to a claimant that I feel it's almost verging on negligence for their solicitors not to advise doing so.

Now that we have an (unacceptable but still sizeable) settlement offer we are preparing the letter of claim and will submit that, as well as a Part 36 Offer at the same time.

We have to work out what level to pitch the Part 36 at. This is probably our biggest conundrum. The legal costs involved will be substantial if the firm doesn't settle and they know they will be on the hook for them.
