Pls Help with Traffic Accident Cost Issues

Greetings


Regarding a traffic accident, my traffic accident but not my fault, I have some problems with the other party. They refuse to pay the following costs:


1- The other party has offered only £2000.00 as compensation for my written off van. An independent engineer has valued my van to £2500.00. His, engineer's, cost was £50.00.


2- I used my credit cards to buy a new van. This has cost me £761.00 in interests.


3- A part from the price of the van, I got an extra cost of £771.00. This includes fares, new sign writing, prepurchase vehicle inspections and fitting a new timing belt.


If I go to the court what are my chances to recover any of the above?

Sorry I missed a point.

My replacement, new, van is smaller than my written off van by 200.00cubic feet and has 300.00kg lower loading capacity. So I am worst off by 200.00 cubic feet in size and 300.00kg in weight. I tried to find a van with a similar loading capacity in size and weight but couldn't find it. Does this entitle me to any compensation?

I have re read your post now, again - you are not entitled to any compensation, however you are entitled to be put back into the same position you were in before the accident. Speak to your insurance company about this and use your legal expenses cover to recover the actual costs.

No it doesn't. You should have bought a similar sized van. The interest on your credit card is nothing to do with the claim either.

I found similar size van but more expensive than the van I bought almost by one and half + VAT. I settled half of the payment from my saving, the rest I couldn't settle. This caused the accumulation of the interest.

For your information I have already been compensated £2000.00 for the van, £2500.00 + £540.00 for personal injuries and £2300.00 in lost earning. This has been offered through the firm appointed to handle my case. But I am happy with the conduct of the firm.

    As your van is at the bottom end of the market you have done well to get the money you actually received from the claim .
    Normally on a newer van you would insure it and if on finance take out a gap insurance to cover any shortfall from an insurance payout .

    I don't know if you can get a gap policy on an older vehicle
