the grey area around wheter you can or cant sell it on is dependant onwhat sort of data it is? if it is personal information like name and address which i presume it is - then the people who gave it to you must have signed or ticked a clause box that tells them what you intend to do with the data, you cant just sell somebodys name and number without their permisions.

Robert1989 is corect.

Its not just permissions, its TPS cleansing too.
There are also issues around the CC Act as well as the DP act.
And don't even go down the FSA regulations surrounding mortgage leads...and compliance...that's even more complex.

Hi All,

<snip>
You carnt cold call if you regulated you get around it by having a marketing company.

Incorrect, twice.

You can cold call for loans, these are regulated under CCA

You cannot cold call for mortagge business, regulated by FSA. I have a marketing company. It has to be compliant in exactly the same way as if I had generated the lead myself. Just because the relationship is arms length, does not mean that the rules and regulations don't exist, or are not still mandatory. Brokers have to source leads using a compliant process, even/expecially if these are outsourced. Any 'authorised introducer' has to have a compliant process, or the lead becomes tainted, and therefore cannot be used by any reputable broker.

Hi,

Thats what i ment you cannot cold call for mortagge business regulated by FSA.
I only started this marketing company this year we do surveys at end of suvey we say "we have numerous arrangements with quality firms who could assistance to you" Would u like a call back to disscuss saving money on mortgage,phone bills,or disscuss consolidating all your debts in to 1 payment.
Get time date for call back?
Is this ok?The brokers who i sell to seem to be fine with it?

Thanks

Dave
