Legal requirements for a recruitment agency?

Hi all,

***posted this in the main forum, think it should be here***

As my user name suggests I am looking to set up new recruitment business.

It will be the healthcare sector, I have some knowledge in this area having worked here previously and do some have some contacts which I will be able to develop to generate business.

I have looked on previous threads on this site and had a look at the rec website.

Will be mainly be looking at temporary contracts.

Looking for tips on what are legal requirements in setting up in recruitment in particular what is required if working in the healthcare field e.g. Specialist insurance?

Your business is heavily regulated. Are you familiar with the regulations concerning employment agencies (e.g. recruitment) and employment businesses (e.g. supply of temporary workers)?
There is an (out dated) Government guide - see;

You need to be familiar with the Conduct of Employment Agencies and Employment Businesses Regulations 2003 as amended (in 2007 and 2010).

You should check the data protection act requirements in relation to your business - visit the Information Commissioner's office website.
As to insurance, I would suggest you ask an insurance broker for specialist liability insurance; have regard to civil liabiliy under reg. 30 of the Regulations.

Andrew is spot on...
In addition you do need to register your agency with the ICO www.ico.gov.uk
You also need to have insurance as you have stated, which Hiscox is the best insurer for Recruitment agencies, they also specialise in temporary recruitment.

With regards to Healthcare, a very hard sector, most of all is PSL's which I am sure you are aware of.
